RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO CALLAWAY GOLF SALE COMPANY FOR THE PURCHASE OF PROFESSIONAL GOLF MERCHANDISE FOR PREAKNESS VALLEY GOLF COURSE, PURSUANT N.J.S.A. 40A: 11-1, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bid and bidding thereof; and
WHEREAS, on January 17, 2024, the County’s Purchasing Agent issued SB-24-020 establishing a pool of qualified vendors for Golf Professional Shop Merchandise Catalog % Discount Pricing for a two-year period beginning March 24, 2024, and expiring on March 23, 2026 (“SB-24-020”), seeking sealed proposals for golf professional shop merchandise catalog % discount pricing for the Preakness Valley Golf Course; and
WHEREAS, on January 30, 2024, the Purchasing Agent received one qualified response from Callaway Golf Sales Company; and
WHEREAS, the Director of the Department of Parks & Recreation is recommending that the Board award a contract to Callaway Golf Sale Company to provide golf professional shop merchandise catalog % discount pricing for a period beginning March 24, 2024, and expiring March 23, 2026, in the amount not to exceed fifty thousand dollars ($50,000.00); and
WHEREAS, Callaway Golf Sale Company has agreed to provide a 10% discount on all catalog products and free freight; and
WHEREAS, funds are available in Account No. 04-01-28-198-002-PO2 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the February 28, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-1, et seq. the Board of County Commissioners of the County of Passaic authorizes an award of contract to Callaway Golf Sale Company to provide golf professional shop merchandise catalog % discount pricing for a period beginning March 24, 2024, and expiring March 23, 2026, in the amount not to exceed fifty thousand dollars ($50,000.00).
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, Clerk of the Board, and County Counsel are hereby authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this Resolution, including but not limited to the issuance of the appropriate Purchase Order.
