RESOLUTION AUTHORIZING THE PASSAIC COUNTY SHERIFF’S OFFICE TO AWARD A CONTRACT TO VARIOUS VENDORS FOR TOWING AND STORAGE FOR PASSAIC COUNTY DEPARTMENTS AND INSTITUTIONS (RFP-24-009), PURSUANT TO N.J.S.A. 40A:11-4.1, ET SEQ.

WHEREAS, the County of Passaic (hereinafter the “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereinafter the “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County requires vendors for towing and storage of vehicles throughout the County and desires to contract with various vendors throughout the region for the time period from March 1, 2024 through February 28 2025 with two (2) one year options; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(i) specifically authorizes the County to utilize competitive contracting to hire a vendor to perform services that are exempt under N.J.S.A. 40A:11-5, including towing services; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R-23-1094 on November 21, 2023, authorizing competitive contracting for towing and storage services; and
WHEREAS, thereafter the Purchasing Agent issued RFP-24-009 Towing and Storage for Passaic County Department and Institutions (“RFP-24-009”), responses which were opened on January 17, 2024; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.5(d), in a memorandum dated February 22, 2024, which is attached to and made part of this Resolution, the proposals submitted the various vendors were reviewed and ranked based on a methodology for the awarding of competitive contracts, which included management, technical and costs; and
WHEREAS, the February 22, 2024, memorandum is recommending an award of contract to the following vendors to be used on a rotating basis in each designated region for a one (1) year term from March 1, 2024, through February 28, 2025, with two (2) one year optional years to renew:
REGION 1 (Passaic, Clifton and Woodland Park):
• Essex County Recovery Bureau
• Raineri’s Services Station, Inc.
• City Wide Towing, Inc.
• JML Inc. d/b/a J&M Towing
REGION 2 (Paterson, Prospect Park and Totowa):
• Essex County Recovery Bureau
• City Wide Towing, Inc.
• JML Inc. d/b/a J&M Towing
• Camp Auto & Truck Parts, Inc.
REGION 3 (Wayne, Pompton Lakes and Little Falls):
• Essex County Recovery Bureau
• City Wide Towing, Inc.
• JML Inc. d/b/a J&M Towing
• Camp Auto & Truck Parts, Inc.
REGION 4 (Hawthorne, Haledon and North Haledon):
• Essex County Recovery Bureau
• City Wide Towing, Inc.
• Raven Towing & Recovery
• Camp Auto & Truck Parts, Inc.
REGION 5 (West Milford, Ringwood, Wanaque and Bloomingdale):
• Essex County Recovery Bureau
• Camp Auto & Truck Parts, Inc.
WHEREAS, fees are to be charged in accordance with the terms of RFP-24-009; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for proposals is a fair and open process, specifically, the request for proposals case management services was publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, this matter was reviewed by the Law and Public Safety Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1 et seq., the Board of County Commissioners for the County of Passaic is authorizing a contract award to various vendors for towing and storages services on a rotating basis in the region for one (1) year from March 1, 2024, through February 28, 2025, with two (2) one year optional years to renew as follows:

LET IT BE FURTHER RESOLVED, the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to these vendors, and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
