RESOLUTION AUTHORIZING A BRIDGE ATTACHMENT PERMIT TO ORANGE AND ROCKLAND ELECTRIC COMPANY TO ATTACH TWO 6-INCH GALVANIZED RIGID STEEL CONDUITS ALONG THE FACE OF WARWICK TURNPIKE CULVERT NO. 1600-447 OVER LITTLE GREEN BROOK IN THE TOWNSHIP OF WEST MILFORD, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, an application for Bridge/Culvert Attachment, was presented to the County Engineer by Orange and Rockland Electric Company to attach two 6-inch galvanized, rigid metallic conduits to the County’s Culvert No. 1600-447 (Warwick Turnpike) over Little Green Brook in the Township of West Milford; and
WHEREAS, Orange and Rockland Electric Company desires to install these conduits for an electrical underground distribution line; and
WHEREAS, as a condition for approval, Orange and Rockland Electric Company must execute a license agreement, requiring Orange and Rockland Electric Company to adhere to certain guidelines, such license agreement also granting the County the right to have such conduits removed at the County’s sole discretion; and
WHEREAS, this matter was discussed at the April 10, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, that the Board of County Commissioners of the County of Passaic authorizes the issuance of a Bridge/Culvert attachment permit to Orange and Rockland Electric Company to install two conduits to Culvert No. 1600-447 (Warwick Turnpike) over Little Green Brook in the Township of West Milford, subject to the above-stated terms and conditions.
LET IT BE FURTHER RESOLVED, that the aforesaid Bridge/Culvert attachment permit is not to be considered a change of policy by the County of Passaic and future requests for Bridge/Culvert attachment permits shall be considered on a case-to-case basis.
LET IT BE FURTHER RESOLVED, the Director of the Board of County Commissioners, Clerk of the Board and County Counsel are hereby authorized to execute an Encroachment Agreement on behalf of Passaic County.
