RESOLUTION TO QUALIFY AND AWARD A CONTRACT TO NJP INSULATION OF PATERSON, NJ IN RESPONSE TO RFQ-24-068: TO EXPAND THE POOL WEATHERIZATION ASSISTANCE PROGRAM (WAP) RESIDENTIAL INSULATION AND VENTILATION REPAIR AND INSTALLATION WITH OTHER ENERGY CONSERVATION MEASURES, IN THE AMOUNT OF $200,000.00.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the County, through its Division of Weatherization and Home Energy (hereafter “Division”) of the Department of Senior Services administers various programs to reduce energy costs for low-income residents in Passaic County by improving energy efficiency; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-24-068: To expand the pool Weatherization Assistance Program (WAP) Residential Insulation and Ventilation Repair and Installation with other Energy Conservation Measures (hereafter “RFQ-24-068”), seeking qualifications for a pool of qualified contractors to provide professional weatherization remediation services consisting of insulation, ventilation, and related work activity for residents of the County; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualifications for RFQ-24-068 are publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, NJP Insulation of Paterson, NJ, submitted a proposal to RFQ-24-068 that included four (4) of the four (4) Categories, A through D, reflecting pricing that is compatible with the WAP guidelines, which was reviewed by the Evaluation and Review Committee and is being recommended for qualification by the Board to be used to provide insulation, ventilation and related work activity for the Division.
WHEREAS, the terms of the contract awarded through RFQ is January 1, 2024 through December 31, 2024; and
WHEREAS, funds are available in Account Nos. G-01-41-705-024-213 and G-01-41-708-023-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et.seq., vendor executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the April 16, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, BE IT RESOLVED, pursuant to N.J.S.A. 40A:11-5, et.seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) awards a Contract to NJP Insulation of Paterson, NJ, to provide insulation, ventilation and related work activity under RFQ-24-068 for four (4) of the four (4) Categories (Categories A through D) for the period of January 1, 2024 through December 31, 2024; and
LET IT FURTHER BE RESOLVED, that the Board is appropriating an amount not to exceed two hundred thousand and 00/100 ($200,000.00) dollars to be used on an as needed basis for contracts entered into under RFQ-24-068 during the period of January 1, 2024 through December 31, 2024; and
LET IT FURTHER BE RESOLVED, that the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount to NJP Insulation of Paterson, NJ, and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT FURTHER BE RESOLVED, that the Director of the Board, County Counsel, and Director of the Weatherization and Home Energy Division, and Purchasing Agent are authorized to take any action necessary to carry out the purpose of this Resolution.
