RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO MICHAEL BAKER INTERNATIONAL, INC., FOR PRELIMINARY ENGINEERING DESIGN CONSULTANT SERVICES FOR THE REPLACEMENT OF SIXTH AVENUE BRIDGE, STRUCTURE #1600-012 OVER THE PASSAIC RIVER IN THE CITY OF PATERSON, BOROUGH OF PROSPECT PARK, AND BOROUGH OF HAWTHORNE, PURSUANT TO N.J.S.A. 40A:11-4.1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, the County is in need of engineering consultant services for preliminary engineering for the replacement of Sixth Avenue Bridge, Structure No. 1600-012) on County Route 652 over the Passaic River in the City of Paterson, Borough of Prospect Park, and Borough of Hawthorne; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1 (i) specifically authorizes the County to utilize competitive contracting for any good or service that is exempt from bidding pursuant to N.J.S.A. 40A:11-5; and
WHEREAS, on April 11, 2023, the Board approved Resolution No. R-23-0373 authorizing the use of competitive contracting to retain a professional consultant to provide consultant engineering services for the Replacement of Sixth Avenue Bridge Structure No. 1600-012, on County Route 652 over the Passaic River, in the City of Paterson, Borough of Prospect Park, and Borough of Hawthorne; and
WHEREAS, on April 12, 2023, the Purchasing Agent issued RFP-23-018 for Professional Engineering Services Regarding Preliminary Engineering for the Replacement of Sixth Avenue Bridge (Structure No. 1600-012) on County Route 652 Over the Passaic River in the City of Paterson, Borough of Prospect Park, and Borough of Hawthorne (hereafter “RFP-23-018”); and
WHEREAS, on May 5, 2023, proposals for RFP-23-018 were unsealed by the Purchasing Agent unsealed, with two (2) responses from Michael Baker International, Inc., and Greenman-Pedersen, Inc.; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.5(d), the proposal submitted was reviewed and ranked by an evaluation committee based on a methodology for the awarding of competitive contracts, which included technical, management, and cost related criteria; and
WHEREAS, a review committee convened and scored the proposals, and is recommending an award of contract to Michael Baker International, Inc., for an amount not to exceed nine hundred nineteen thousand eight hundred ninety-five dollars and nineteen cents ($919,895.19) as set forth in the memorandum attached to and made part of this Resolution, to provide engineering consultant services under RFP-23-018; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for proposals is a fair and open process, specifically, RFP-23-018 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, the preliminary engineering design phase of the project to replace the Sixth Street Bridge (Structure No. 1600-012) on County Route 652 Over the Passaic River in the City of Paterson, Borough of Prospect Park, and Borough of Hawthorne is being funded by a Federal Aid Agreement 2023-DT-BLA1-03 from the NJDOT; and
WHEREAS, funds are available in Account No. G-01-45-702-023-9B9, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the April 10, 2024 Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1 et seq., the Board of County Commissioners of the County of Passaic authorizes an award of contract to Michael Baker International, Inc., for an amount not to exceed nine hundred nineteen thousand eight hundred ninety-five dollars and nineteen cents ($919,895.19), to provide engineering consultant services under RFP-23-018.
LET IT BE FURTHER RESOLVED, the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to Michael Baker International, Inc. and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board of County Commissioners are authorized to take any other steps necessary to carry out the purpose of this Resolution.
