RESOLUTION AUTHORIZING A LEASE AGREEMENT BY AND BETWEEN THE COUNTY OF PASSAIC AND THE PATERSON PARKING AUTHORITY FOR JUROR PARKING SPACES AT VARIOUS LOCATIONS NEAR THE PASSAIC COUNTY SUPERIOR COURTHOUSE, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to the Parking Authority Law, N.J.S.A. 40:11A-1, et seq., the City of Paterson created the Paterson Parking Authority, which owns and operates various parking facilities within the City of Paterson; and
WHEREAS, the County is in need of fifty (50) parking spaces for jurors summoned for jury duty at the Passaic County Superior Courthouse; and
WHEREAS, the Paterson Parking Authority has agreed to lease fifty (50) parking spaces to the County for a contract term, beginning May 1, 2024 and terminating December 31, 2024, in an amount not to exceed thirty thousand dollars ($30,000.00), at a monthly rate of three thousand seven hundred fifty dollars ($3,750.00), with two (2) one-year options to be exercised at the discretion of the Board no later than November 1, of each contract year; and
WHEREAS, the Parties memorialized the terms of the lease in the Lease Agreement, attached hereto and made part of this Resolution, which the Passaic County Administrator is recommending to the Board for approval; and
WHEREAS, funds are available in Account No. 4-01-20-112-001-235, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the April 10, 2024 Administration & Finance Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic authorizes the attached Lease Agreement by and between the County of Passaic and the Paterson Parking Authority, for a contract term, commencing May 1, 2024 and expiring December 31, 2024, in an amount not to exceed thirty thousand dollars ($30,000.00), whereby the Paterson Parking Authority agrees to make available fifty (50) parking spaces for jurors summoned for jury duty at the Passaic County Superior Courthouse.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Administrator, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
