RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO NIELSEN FORD OF MORRISTOWN, INC., FOR TWO (2) WHITE 2024 FORD EXPLORERS FOR THE COUNTY OF PASSAIC ROAD DEPARTMENT, PURSUANT TO N.J.S.A. 40A:11-10.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq.; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Educational Service Commission of New Jersey Cooperative Contract Purchasing System 65MCESCCPS (hereafter “65MCESCCPS”), a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, in compliance with the law, 65MCESCCPS issued and awarded a contract to Nielsen Ford of Morristown, Inc, for Cars, Crossovers, Class 1-3 Pickup Truck/ Chassis, Sport Utility Vehicles, and Vans under contract ESCNJ 23/24-11(hereafter “ESCNJ 23/24-11”); and
WHEREAS, the Supervisor of Roads is recommending that the Board authorize an award of contract to Nielsen Ford of Morristown, Inc., to purchase two (2) white 2024 Ford Explorers (K8B) Base 4WD, under ESCNJ 23/24-11 through the Educational Service Commission of New Jersey Cooperative in an amount not to exceed eighty-six thousand five hundred eighteen dollars and sixty-six cents ($86,518.66); and
WHEREAS, funds are available in Account No. 4-01-44-900-003-000, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 8, 2024, Public Works Committee meeting and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to Nielsen Ford of Morristown Inc., to purchase two (2) white 2024 Ford Explorers (K8B) Base 4WD under Contract ESCNJ 20/21-63 through the Educational Service Commission of New Jersey Cooperative in an amount not to exceed eighty-six thousand five hundred eighteen dollars and sixty-six cents ($86,518.66).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
