RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO RFS COMMERICAL INC., TO REMOVE AND REPLACE FLOORING IN VARIOUS PASSAIC COUNTY BUILDINGS PURSUANT TO N.J.S.A. 40A:11-10 & N.J.S.A. 40:11-12

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq.; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, pursuant to N.J.S.A. 40A:11-12, et seq. the County may without advertising for bids purchase goods or services under any contract or contracts for such goods or service entered into on behalf of the State by the Division of Purchase and Property in the Department of Treasury; and
WHEREAS, the County is a member of the Hunterdon County Educational Services Commission Cooperative Purchasing Program #34HUNCCP (hereafter “#34HUNCCP”), a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, in compliance with the law, #34HUNCCP issued and awarded a contract to RFS Commercial Inc., under Commercial Floor Covering & Related Service #215; and
WHEREAS, RFS Commercial, Inc., submitted a competitive price under State Contract 22-FOOD-47763 for flooring furniture window treatments concrete to the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, the Superintendent of Buildings & Grounds is recommending that the Board authorize an award of contract to RFS Commercial Inc., to remove and replace flooring in various Passaic County Buildings under Commercial Floor Covering & Related Service #215 through the Educational Services Commission Cooperative Purchasing Program and to remove and replace flooring in various Passaic County Buildings under State Contract 22-FOOD-47763 for flooring furniture window treatments concrete, in an amount not to exceed one hundred seven thousand, one hundred thirteen dollars and seventy-two cents ($107,113.72), which includes the following cost proposal; and
WHEREAS, funds are available in Account No. 4-01-44-900-003-002 9($100,000), 4-01-20-112-001-207 ($7,113.72), or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 8, 2024, Public Works Committee meeting and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to remove and replace flooring in various Passaic County Buildings under Commercial Floor Covering & Related Service #215 through the Educational Services Commission Cooperative Purchasing Program and to remove and replace flooring in various Passaic County Buildings under State Contract 22-FOOD-47763 for flooring furniture window treatments concrete, in an amount not to exceed one hundred seven thousand one hundred thirteen dollars and seventy-two cents ($107,113.72).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
