RESOLUTION AUTHORIZING EXECUTION OF A MAINTENANCE AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND THE BOROUGH OF BLOOMINGDALE, PURSUANT TO N.J.S.A. 40:20-1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, the County has recently become responsible for the maintenance of six culverts located in the Borough of Bloomingdale along Bailey Brook, and approximately located at Oak Street, Chestnut Street, Tice Street, Van Dam Street, Poplar Street, and Walnut Street, all in the Borough of Bloomingdale; and
WHEREAS, said culverts are currently suffering from restricted water flow due to prolonged build-up of silt; and
WHEREAS, the Passaic County Engineer is recommending that the Board authorize an agreement between the County and Borough of Bloomingdale, whereby the Borough of Bloomingdale performs the removal of debris from the above-described culverts, and the County reimburses the Borough of Bloomingdale for the cost of services rendered, in an amount not to exceed thirty thousand eight hundred dollars ($30,800.00); and
WHEREAS, funds are available in Account No. C-04-55-148-001-9B1 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 8, 2024 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1 et seq., the Board of County Commissioners of the County of Passaic hereby authorizes the execution of an agreement between the County of Passaic and the Borough of Bloomingdale to remove debris from six (6) culverts in the Borough of Bloomingdale, whereby the County will reimburse the Borough of Bloomingdale in an amount not to exceed thirty thousand eight hundred dollars ($30,800.00).
LET IT BE FURTHER RESOLVED that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to take any other steps necessary to carry out the purpose of this resolution.
