RESOLUTION AUTHORIZING A NON-FAIR AND OPEN CONTRACT TO INTERCYCLE, LLC D/B/A RECYCLINGBIN.COM FOR THE PURCHASE OF THIRTEEN (13) RECYCLING COLLECTION BINS FOR THE COLLECTION OF STYROFOAM PACKAGING GENERATED BY PASSAIC COUNTY RESIDENTS, PURSUANT TO N.J.S.A. 40A:11-6.1, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Department of Health Services is responsible for protecting and promoting the health of approximately 510,000 County residents; and
WHEREAS, the Department of Health Services, Recycling and Natural Resources Division coordinates all solid waste and recycling planning functions on behalf of the County and its municipalities; and
WHEREAS, pursuant to N.J.S.A. 40A:11-6.1(a), the Recycling and Natural Resources Division solicited quotes for the purchase of thirteen (13) foam recycling collection bins; and
WHEREAS, the quote received from Intercycle, LLC d/b/a Recyclingbin.com is the quote most advantageous to the County, price and other factors considered, which is attached hereto and made part of this Resolution; and
WHEREAS, the Director of the Recycling and Natural Resources Division is recommending a non-fair and open contract award to Intercycle, LLC d/b/a Recyclingbin.com for the purchase and shipping of thirteen (13) foam recycling collection bins for the collection of Styrofoam packaging generated by County residents, in an amount not to exceed thirty-two thousand five hundred ninety-seven dollars ($32,597.00); and
WHEREAS, the collection bins purchased from Intercycle, LLC d/b/a Recyclingbin.com will be installed in thirteen (13) County municipalities for used by all sixteen (16) municipalities in the County; and
WHEREAS, Intercycle, LLC d/b/a Recyclingbin.com executed and notarized the County’s Business Entity Disclosure Certification for non-fair and open contracts required pursuant to N.J.S.A. 19:44A-20.8, which is attached hereto and made part of this Resolution; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., Intercycle, LLC d/b/a Recyclingbin.com executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed the vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Accounts No. G-01-41-761-021-PE1 ($27,807.00) and G-01-41-761-020-213 ($4,790.00), or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 7, 2024, Health and Human Services Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-6.1(a), the Board of County Commissioners of the County of Passaic authorizes a non-fair and open contract to Intercycle, LLC d/b/a Recyclingbin.com for the purchase and shipping of thirteen (13) foam recycling collection bins for the collection of Styrofoam packaging generated by Passaic County residents, in an amount not to exceed thirty-two thousand five hundred ninety-seven dollars ($32,597.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract awarded to Intercycle, LLC d/b/a Recyclingbin.com, and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Recycling and Natural Resources Division, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
