RESOLUTION AUTHORIZING EXECUTION OF AN “IF AND WHEN AGREEMENT” ASSOCIATED WITH A PASSAIC COUNTY PLANNING BOARD APPLICATION FOR A PROPOSED RESIDENTIAL DETOX FACILITY AT 1140 GREENWOOD LAKE TURNPIKE, RINGWOOD, NEW JERSEY; BLOCK: 311, LOT: 2.

WHEREAS, the Passaic County Department of Planning and Economic Development is in receipt of an “If and When Agreement” between Avatar Residential Detox Center and the County of Passaic; and
WHEREAS, the Agreement is being required as part of the site plan approval for an application at the Avatar Residential Detox Center in Clifton; and
WHEREAS, the Greenwood Lake Turnpike and Margaret King Avenue are CR 611 and CR 698 County roads; and
WHEREAS, there is no exiting sidewalk or full height curbing along the Union Valley Road frontage of the site; and
WHEREAS, the sidewalk and curbing would be installed by the property owner if and when requested by the County and at no cost to the County; and
WHEREAS, the site has frontage along Greenwood Lake Turnpike CR 511 and Margaret King Avenue CR 698 in Ringwood; and
WHEREAS, there is no existing sidewalk or full height curbing along the Union Valley Road frontage of the site; and
WHEREAS, the distance from the site driveway to the side property line shall be dimensioned on the plan. A ten (10”) foot minimum offset is required; and
WHEREAS, this Agreement was required by the Planning Board to allow for the County to request the installation of sidewalk and curbing at a future date; and
WHEREAS, the attached Agreement has been reviewed by the Planning Board and Engineering Staff and deemed acceptable, and the most recent Planning Board Review Letter, dated April 5, 2024, and Site Plan are also attached hereto.
WHEREAS, this matter was discussed at the May 8, 2024, meeting of the Planning and Economic Development Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, the Passaic County Board of Commissioner authorizes the execution of the “If and When Agreement” between Avatar Residential Detox Center and the County of Passaic; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, the County Counsel, the Director of the Board and the Director of the Planning & Economic Development are authorized to take any other steps necessary to carry out the purpose of this Resolution.
