RESOLUTION RECOGNIZING A VENDOR NAME CHANGE FROM DIRECT ENERGY BUSINESS MARKETING, LLC TO NRG BUSINESS MARKETING, LLC, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, on September 28, 2021, the Board passed Resolution No. R20210860, qualifying Direct Energy Business Marketing, LLC as a New Jersey Board of Public Utilities Licensed Third Party Electric and/or Natural Gas Supplier under RFQ-21-098; and
WHEREAS, on November 23, 2021, the Board passed Resolution R20211060, awarding a contract to Direct Energy Business Marketing, LLC for Bid Group 1 under SB-21-059 to provide natural gas supply services to participating members of the Passaic County Energy Regional Cooperative Pricing System, ID#203PCERCPS; and
WHEREAS, it is necessary to acknowledge Direct Energy Business Marketing, LLC’s name change to NRG Business Marketing, LLC for procurement and purchasing purposes; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., NRG Business Marketing, LLC executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed NRG Business Marketing, LLC is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the May 29, 2024 Health and Human Services Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic hereby recognizes Direct Energy Business Marketing, LLC’s name change to NRG Business Marketing, LLC for procurement and purchasing purposes.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
