RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO GROFF TRACTOR HOLDINGS, LLC, TO REPAIR TWO CASE WHEEL LOADERS FOR THE ROAD DEPARTMENT, PURSUANT TO N.J.S.A. 40A: 11-12, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Supervisor of Roads determined that two CASE Wheel Loaders owned and operated by the County were in need of repair;
WHEREAS, pursuant to N.J.S.A. 40:11-12, et seq., the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract or contracts for such goods or services entered into on behalf of the State of New Jersey by the Division of Purchase and Property in the Department of Treasury; and
WHEREAS, Groff Tractor Holdings, LLC, submitted a competitive pricing under T3057-Wheel Loader and Attachments, Master Blanket Purchase Order #17-FLEET-00202, to the State of New Jersey, Division of Purchase and Property in the Department of Treasury; and
WHEREAS, Groff Tractor Holdings, LLC, provided a quote for towing, parts, and repair of two CASE Wheel Loaders owned by the County in the amount of eighteen thousand four hundred eighty-nine dollars and fifty-five cents ($18,489.55), attached to and made part of this resolution; and
WHEREAS, the Supervisor of Roads is recommending that the Board authorize an award of contract to Groff Tractor Holdings, LLC, for towing, parts, and repair of two CASE Wheel Loaders owned by the County in the amount of eighteen thousand four hundred eighty-nine dollars and fifty-five cents ($18,489.55); and
WHEREAS, funds are available in Account No. 3-01-26-151-001-222 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 29, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12, et seq. that the Board of County Commissioners of the County of Passaic authorizes an award of contract to Groff Tractor Holdings, LLC for towing, parts, and repair of two CASE Wheel Loaders owned by the County in the amount of eighteen thousand four hundred eighty-nine dollars and fifty-five cents ($18,489.55), as recommended by the Supervisor of Roads.
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, Clerk of the Board, Supervisor of Roads, and County Counsel are hereby authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this Resolution, including but not limited to issuance of the appropriate Purchase Order.
