RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO KEVIN DOWNES TREE SERVICES CO., TO CUT AND REMOVE DEAD OR FALLEN TREES ON PASSAIC COUNTY ROADWAYS AND RIGHT-OF-WAYS FOR CALENDAR YEAR 2024 PURSUANT TO N.J.S.A. 40A:11-10

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq.; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Bergen County Cooperative Contract Purchasing System 11BCCPS (hereafter “11BCCPS”), a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, in compliance with the law, 11BCCPS issued and awarded a contract to Kevin Downes Tree Services Co., under Dead Tree Removal Services-Municipal Owned Roads- under contract CK04 COOP, BC-23-54 (hereafter “BC-23-54”); and
WHEREAS, the Supervisor of Roads is recommending that the Board authorize an award of contract to Kevin Downes Tree Services Co., to cut and remove dead or fallen trees on Passaic County Roadways and Right-of-Ways for the calendar year 2024 in an amount not to exceed seventy thousand dollars ($70,000.00); and
WHEREAS, funds are available in Account No. 4-01-26-151-001-213, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 29, 2024, Public Works Committee meeting and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to Kevin Downes Tree Services Co., under Contract BC-23-54, to cut and remove dead or fallen trees on Passaic County Roadways and Right-of-Ways for the calendar year 2024 in an amount not to exceed seventy thousand dollars ($70,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
