RESOLUTION AUTHORIZING AN IN INCREASE IN THE APPROPRIATION TO QUALIFYING VENDORS FOR RFQ-24-035: RESIDENTIAL LEAD REMEDIATION AND ABATEMENT SERVICES ON AN AS-NEEDED BASIS BY THE DIVISION OF WEATHERIZATION, PURSUANT TO N.J.S.A. 40A:11-5, ET SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the County, through its Division of Weatherization and Home Energy (hereafter “Division”) of the Department of Senior Services administers various programs to reduce energy costs for low-income residents in Passaic County by improving energy efficiency; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-24-035: Residential Lead Remediation and Abatement Services (hereafter “RFQ-24-035”), seeking qualifications providing professional lead remediation and abatement services; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualification for RFQ-24-035 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, the Director of the Division requested that the Board qualify and authorize an award contract to the following vendors to provide residential lead remediation and abatement services on an as-needed basis in the amount of one million one hundred eleven thousand four hundred twenty seven and 00/100 ($1,111,427.00) dollars;
A-Arcalenz, LLC of West Orange, New Jersey;
Artistic Building Trades, LLC of Union, New Jersey;
BGI Resources International Corporation of Cherry Hill, New Jersey;
Optimum Environmental Solutions, LLC of Union, New Jersey;
Pow/R/Save. Inc. of Clifton, New Jersey;
Tahshin Construction, LLC of Egg Harbor Township, New Jersey; and
WHEREAS, pursuant to Resolution R-24-1056, dated November 21, 2023, the Board passed a resolution qualifying and awarding the various vendors for residential lead remediation and abatement services, on an as-needed basis set forth above; and
WHEREAS, subsequently, the Division received the Lead Remediation and Abatement 2023 Tranche 2 Grant, and is requesting to add 2023 Tranche 2 Funds in the amount of one million one hundred eleven thousand four hundred twenty seven and 00/100 ($1,111,427.00) dollars to the appropriation amount for the qualified vendors above, increasing the total appropriation amount for RFQ-24-035 to two million thirty three thousand four hundred twenty seven and 00/100 ($2,033,427.00) dollars;
WHEREAS, funds are available in Account No. G-01-41-709-024-213 any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendors executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendors are not involved in prohibited activities in Russia and Belarus, and the County confirmed vendors are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the June 18, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby authorizes an increase in appropriation for the contracts to the above qualified vendors under RFQ-24-035 in the amount of one million one hundred eleven thousand four hundred twenty seven and 00/100 ($1,111,427.00) dollars on an as-needed basis for the period January 1, 2024 through December 31, 2024, increasing the total appropriation amount to two million thirty three thousand four hundred twenty seven and 00/100 ($2,033,427.00) dollars; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board shall print in the official newspaper a brief notice stating the nature, duration, service, and amount of the contracts to A-Arcalenz, LLC of West Orange, NJ; Artistic Building Trades, LLC, of Union, NJ; BGI Resources International Corp., of Cherry Hill, NJ; Optimum Environmental Solutions, LLC, of Union, NJ; Pow/R/Save, Inc., of Clifton, NJ; and Tahshin Construction, LLC, of Egg Harbor Township, NJ, and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board; and
LET IT BE FURTHER RESOLVED, that the Director of the Board, the Clerk to the Board, County Counsel, Director to the Weatherization & Home Energy Division, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this Resolution.
