RESOLUTION AUTHORIZING COMPETITIVE CONTRACTING FOR MICRO-TRANSIT TRANSPORTATION SERVICES FOR THE COUNTY OF PASSAIC, PURSUANT TO N.J.S.A. 40A:11-4.1(k)

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County is desirous of soliciting proposals from qualified professionals to provide micro-transit transportation services to the County; and
WHEREAS, N.J.S.A. 40A:11-4.1, et seq. authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(k) specifically authorizes the County to utilize competitive contracting to procure the operation, management or administration of other services, with the approval of the Director of the Division of Local Government Services; and
WHEREAS, the Passaic County Purchasing Agent requested and received approval from the Director of the Division of Local Government Services to procure micro-transit transportation services through competitive contracting, as stated in the letter dated July 1, 2024, attached hereto and made part of this Resolution; and
WHEREAS, N.J.S.A. 40A:11-4.3 requires the County to pass a resolution authorizing the use of competitive contracting each time specialized goods or services enumerated under N.J.S.A. 40A:11-4.1 are contracted for; and
WHEREAS, this matter was discussed at the July 3, 2024 Administration and Finance Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1(k), the Board of County Commissioners of the County of Passaic authorizes competitive contracting to procure micro-transit transportation services for the County of Passaic.
LET IT BE FURTHER RESOLVED, that the Passaic County Purchasing Agent is hereby authorized and directed to initiate the competitive contracting process in compliance with N.J.S.A. 40A:11-4.1, et seq.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Administrator, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
