RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION FOR THE CONTRACT THE McCLOSKEY MECHANICAL CONTRACTOR, INC., TO REPAIR AND REPLACE AIR CONDITIONER CHILLLERS AT PREAKNESS HEALTHCARE CENTER, PURSUANT TO N.J.S.A. 40A:11-10., ET.SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, et.seq., the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of good and services to be used by their respective jurisdictions; and
WHEREAS, on October 8, 2019, the Board passed Resolution R20190912, authorizing the County to enter into the Hunterdon County Educational Services Commission, No. 34-HUNCCP, which awarded a contract for HVAC services, No. HCESC-SER-21A to multiple vendors, including McCloskey Mechanical Contractor, Inc., engaged in the business of HVAC repair and maintenance; and
WHEREAS, on November 22, 2022, the Board passed Resolution No. R20221014 authorizing an award of contract to McCloskey Mechanical Contractors, Inc., through Hunterdon County Educational Services Commission, to repair a damaged chiller and install a new chiller at Preakness Healthcare Center, in an amount not to exceed one hundred twenty thousand three hundred forty four dollars and 24/100 ($120,344.24) cents; and
WHEREAS, pursuant to Resolution R-23-010, dated February 14, 2023, the Board of County Commissioners of the County of Passaic authorized an increase in appropriation under the contract with McClosky Mechanical Contractors, Inc., by twenty eight thousand seventy four dollars and 27/100 ($28,074.27) cents for a new total contract in the amount of one hundred forty eight thousand four hundred eighteen and 51/100 ($148,418.51) cents due to an unforeseen increase in the work required to complete the project.
WHEREAS, the Executor Director of Preakness Healthcare Center is recommending that the Board increase the appropriation under the contract with McClosky Mechanical Contractors, Inc. by two hundred ninety seven dollars and 60/100 ($297.60) cents.
WHEREAS, funds are available in Account No. C-04-55-163-002-901 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent County budget(s); and
WHEREAS, this matter was discussed at the July 9, 2024 Health and Human Services Committee meeting and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.AC. 5-30-11.6, the Board of County Commissioners of the County of Passaic (hereafter “County”) authorizes an additional appropriation of two hundred ninety seven dollars and 60/100 ($297.60) cents, for a new total contract in the amount of one hundred forty eight thousand seven hundred sixteen dollars and 11/100 ($148,716.11) cents due to an unforeseen increase in the work required to complete the project.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board shall print in the official newspaper, a brief notice stating the nature, duration, service and amount of the contract awarded to McClosky Mechanical Contractors, Inc., and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Executive Director of Preakness and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
