RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND THE BOROUGH OF WOODLAND PARK TO RELOCATE A WATER MAIN UNDERNEATH LOWER NOTCH ROAD, PURSUANT TO N.J.S.A. 40:20-1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, the County is in the final design stages of the Replacement of the Lower Notch Road Culvert No. 1600-214 over Great Notch Brook in the Borough of Woodland Park (hereafter “Project”); and
WHEREAS, the Borough of Woodland Park (hereafter “Borough”) is responsible for the maintenance of a water main underneath Lower Notch Road and in close proximity to the Lower Notch Culvert No. 1600-214; and
WHEREAS, the aforementioned water main must be relocated as part of the Project; and
WHEREAS, the Passaic County Engineer is recommending that the Board authorize an agreement between the County and Borough of Woodland Park, whereby the County agrees to relocate the aforementioned water main as part of the Project, and the Borough agrees to reimburse the County the costs associated with such relocation; and
WHEREAS, this matter was discussed at the July 3, 2024 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1 et seq., the Board of County Commissioners of the County of Passaic hereby authorizes the execution of an agreement between the County of Passaic and the Borough of Woodland Park whereby the County of Passaic agrees to relocate the Borough of Woodland Park’s water main under Lower Notch Road as part of the Replacement of the Lower Notch Road Culvert No. 1600-214 over Great Notch Brook, and the Borough of Woodland Park agrees to reimburse the County the costs associated with such relocation.
LET IT BE FURTHER RESOLVED that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to take any other steps necessary to carry out the purpose of this resolution.
