RESOLUTION AUTHORIZING A CONTRACT TO MOTOROLA SOLUTIONS, INC., FOR THE DESIGN, SUPPLY, INSTALLATION, COMMISSION, AND TEST OF THE PUBLIC SAFETY DISTRIBUTED ANTENNA SYSTEM FOR USE BY THE PASSAIC COUNTY SHERIFF’S OFFICE, PURSUANT TO N.J.S.A. 40A:11-12 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff’s Office (hereafter “PCSO”) has requested a contract with Motorola Solutions, Inc., for the design, supply, installation, commission, and test of the Public Safety Distributed Antenna System, needed to rectify the portable police radio communication in and around PCSO headquarters; and
WHEREAS, said goods and services are being procured through State Contract as permitted N.J.S.A. 40A:11-12 et seq. and as specified below; and
WHEREAS, pursuant to N.J.S.A. 40A:11-12, et seq, the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract(s) for such goods and services entered into on behalf of the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, Motorola Solutions, Inc. submitted competitive pricing for T0109 - Radio Communication Equipment and Accessories, Master Blanket Purchase Order 83909, to the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, the PCSO received a quote dated June 5, 2024 from Motorola Solutions, Inc., attached hereto and made part of this Resolution, for the design, supply, installation, commission, and testing of the Public Safety Distributed Antenna System, which is needed to rectify the portable police radio communication in or around PCSO headquarters, in an amount not to exceed eighty-five thousand dollars ($85,000.00); and
WHEREAS, the Board is desirous of approving said purchases in accordance with the terms of the applicable contracts and authorizing the Purchasing Agent to issue the appropriate Purchase Orders; and
WHEREAS, this matter has been reviewed by the Law and Public Safety Committee and is being recommended to the Board of for approval; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed they are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in the account stated below or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12 et seq. by the Board of County Commissioners of the County of Passaic that it hereby authorizes the purchase of the following goods and/or services in accordance with the terms of the applicable State Contract:
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, Sheriff, Clerk to the Board, and Director of the Board be and hereby are authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this resolution, including but not limited to issuance of appropriate Purchase Orders
