RESOLUTION INCREASING THE APPROPRIATION TO VARIOUS VENDORS UNDER RFP-21-020 AND RFP-21-025, PASSAIC COUNTY DEPARTMENT OF SENIOR SERVICES DISABILITY AND VETERANS’ AFFAIRS 2022-2024 CARES POOL OF PROVIDERS, PURSUANT TO N.J.S.A. 40A:11-4.1, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County, through its Department of Senior Services, assists with senior benefit programs, including home and community services to senior citizens throughout the County; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, on April 27, 2021, the Board approved Resolution No. R20210423, authorizing competitive contracting for service providers who specialize in providing access, home support services, community support services, and nutrition services for County residents aged sixty years or older; and
WHEREAS, on July 21, 2021, the Passaic County Purchasing Agent unsealed responses to Passaic County Department of Senior Services, Disability and Veterans Affairs 2022-2024 CARES Pool of Providers, RFP-21-020 (“RFP-21-020”); and
WHEREAS, on August 20, 2021, the Purchasing Agent unsealed responses to Re-Bid Passaic County Department of Senior Services, Disability and Veterans Affairs 2022-2024 CARES Pool of Providers, RFP-21-025 (“RFP-21-025”); and
WHEREAS, in accordance with the law, a Review Committee was convened to review the responses to RFP-21-020 and RFP-21-025 and recommended awards of contract to Above and Beyond Home Care Services, Always There, Inc., Visiting Homemaker Services of Passaic County d/b/a/ Home Care Options, Inc., and Connect America.com, LLC; and
WHEREAS, on November 23, 2021, the Board passed Resolution No. R20211082, authorizing an award of contract to Above and Beyond Home Care Services, Always There, Inc., Visiting Homemaker Services of Passaic County d/b/a/ Home Care Options, Inc., and Connect America.com, LLC to provide home health aide services, nursing home placement services, emergency response services, and adult day care services for a contract term, beginning on January 1, 2022 and ending on December 31, 2024, in an amount not to exceed three hundred forty-eight thousand dollars ($348,300.00), in accordance with RFP-21-020 and RFP-21-025; and
WHEREAS, on June 13, 2023, the Board passed Resolution No. R-23-0560, increasing the appropriation to the aforementioned vendors under RFP-21-020 and RFP-21-025, in an amount not to exceed five hundred sixty-three thousand seven hundred thirty-five dollars ($563,735.00); and
WHEREAS, the Director of Senior Services is recommending to increase the appropriation to Above and Beyond Home Care Services, Always There, Inc., Visiting Homemaker Services of Passaic County d/b/a/ Home Care Options, Inc., and Connect America.com, LLC, in an amount not to exceed three hundred twenty-nine thousand dollars ($329,000.00), given that the Department received additional funding that will cover expenses until the expiration of the contracts awarded under RFP-21-020 and RFP-21-025; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., the vendors executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendors are not involved in prohibited activities in Russia and Belarus, and the County confirmed the vendors are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. G-01-41-801-024-213, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the July 9, 2024, Health & Human Services Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic authorizes an additional appropriation to Above and Beyond Home Care Services, Always There, Inc., Visiting Homemaker Services of Passaic County d/b/a/ Home Care Options, Inc., and Connect America.com, LLC to provide home health aide services, nursing home placement services, emergency response services, and adult day care services for the contract term, commencing on January 1, 2022 and expiring on December 31, 2024, in an amount not to exceed three hundred twenty-nine thousand dollars ($329,000.00), in accordance with RFP-21-020 and RFP-21-025.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract modifications awarded herein, and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of Senior Services, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
