RESOLUTION AUTHORIZING THE COUNTY TO EXECUTE AN EASEMENT AGREEMENT WITH NEW JERSEY TRANSIT FOR A PORTION OF THE COUNTY RIGHT OF WAY ON MAIN AVENUE IN THE CITY OF PASSAIC, FOR NEW JERSEY TRANSIT MAIN AVENUE BUS TERMINAL PROJECT, PURSUANT TO N.J.S.A. 40A:12-5

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, on August 11, 2020, the Board passed Resolution No. R20200663, indicating the County’s support for New Jersey Transit’s Main Avenue Bus Terminal Project (hereafter “Project), which involves replacing parking spaces in the center aisle along Main Avenue between Passaic Street and Park Place in the City of Passaic with bus stations, passenger shelters, bus access, and roadway lane reconfigurations; and
WHEREAS, the County is responsible for the maintenance of Main Avenue in the City of Passaic; and
WHEREAS, in order to move forward with the Project, New Jersey Transit must acquire from the County an easement to utilize a portion of the County’s right-of-way on Main Avenue in the City of Passaic; and
WHEREAS, the Passaic County Engineer recommending that the Board authorize the execution of an easement, granting New Jersey Transit the right to utilize portions of the County’s right-of-way on Main Avenue in the City of Passaic for the planned bus terminal, such proposed easement attached hereto and made part hereof; and
WHEREAS, this matter was discussed on July 11, 2024 via email by the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-5, that the Board of County Commissioners of the County of Passaic hereby authorize the execution of an Easement Agreement between the County of Passaic and New Jersey Transit, granting New Jersey Transit the right to utilize a portion of the County’s right-of-way on Main Avenue in the City of Passaic for New Jersey Transit’s Main Avenue Bus Terminal Project.
LET IT BE FURTHER RESOLVED, the Director of the Board of County Commissioners, Clerk of the Board and County Counsel are hereby authorized to execute a Deed of Easement on behalf of Passaic County.
