RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION TO CARRIER CORPORATION TO PERFORM HOURLY SERVICES AND PROVIDE PARTS FOR HVAC EQUIPMENT THROUGHOUT VARIOUS COUNTY OF PASSAIC FACILITIES FROM JANUARY 1, 2024, THROUGH DECEMBER 31, 2024, PURSUANT TO N.J.S.A. 40A:11-10, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Bergen County Cooperative Contract Purchasing System #11BCCPS (“#11BCCPS”) a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, on February 13, 2024, the Board passed Resolution No. R-24-149 authorizing an award of contract to Carrier Corporation for HVAC services under Contract #BC-Bid-22-01.1 through the Bergen County Cooperative, in an amount not to exceed three hundred fifty thousand dollars ($350,000.00), beginning on January 1, 2024, and expiring on December 31, 2024; and
WHEREAS, the Superintendent of Buildings and Grounds is recommending an increase in appropriation to Carrier Corporation in the amount of seventy-five thousand dollars ($75,000.00) to perform hourly service and provide parts for the HVAC equipment throughout various County of Passaic Facilities from January 1, 2024, through December 31, 2024; and
WHEREAS, this matter was discussed at the July 31, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval; and
WHEREAS, funds are available in Account No. 4-01-20-112-001-213, or any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant N.J.S.A. 40A:11-10, the Board of County Commissioners of the County of Passaic is authorizing an increase in the appropriation under the contract to Carrier Corporation in the amount of seventy-five thousand dollars ($75,000.00) to perform hourly service and provide parts for the HVAC equipment throughout various County of Passaic Facilities from January 1, 2024 through December 31, 2024, which will increase the total contract amount to four hundred twenty-five thousand dollars ($425,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
