RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION TO McCLOSKEY MECHANICAL CONTRACTORS, INC., TO SERVICE THE UNFORESEEN METAL REPAIRS AND ADDITIONAL EPOXY COATING FOR THE PASSAIC COUNTY COURT HOUSE ANNEX LOCATED AT 77 HAMILTON STREET IN THE CITY OF PATERSON, PURSUANT TO N.J.S.A. 40A:11-10, ET SEQ

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Hunterdon County Educational Services Commission #34HUNCCP (“#34HUNCCP”) a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, on July 16, 2024, the Board passed Resolution No. R-24-642 authorizing an award of contract to McCloskey Mechanical Contractors, Inc., for HVAC repair services under Contract HCESC-SER-21A through the Hunterdon County Cooperative in the in an amount not to exceed sixty-six thousand two hundred fifty-two dollars ($66,252.00); and
WHEREAS, the Superintendent of Buildings and Grounds is recommending an increase in appropriation to McCloskey Mechanical Contractors, Inc., in the amount of eight thousand three hundred ten dollars and twenty-eight cents ($8,310.28) to service the unforeseen Metal Repairs and additional Epoxy coating for the Passaic County Court House in the City of Paterson, in accordance with Quote #W06242024-D4 Change Order #2, which is incorporated by referenced and made a part of this Resolution; and
WHEREAS, this matter was discussed at the July 31, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval; and
WHEREAS, funds are available in Account No. C-04-55-166-002-903, or any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant N.J.S.A. 40A:11-10, the Board of County Commissioners of the County of Passaic is authorizing an increase in the appropriation under Contract HCESC-SER-21A to McCloskey Mechanical Contractors, Inc., in the amount of eight thousand three hundred ten dollars and twenty-eight cents ($8,310.28) for unforeseen Metal Repairs and additional Epoxy coating, in accordance with Quote #W06242024-D4 Change Order #2, which is incorporated by referenced and made a part of this Resolution and will increase the total contract amount to seventy-four thousand five hundred sixty-two dollars and twenty-eight cents ($74,562.28).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
