RESOLUTION AUTHORIZING THE DEPARTMENT OF HUMAN SERVICES TO EXECUTE THE FIRST ONE-YEAR OPTION TO RENEW TO CULTURAL LEARNING CENTER, INC., UNDER RFP-23-025, PROGRAMS FOR PASSAIC COUNTY HUMAN SERVICES WORKFIRST NEW JERSEY TANF GA SNAP GRANT PARTICIPANTS WITH ADULT BASIC EDUCATION FOR A TERM OF JULY 1, 2024, TO JUNE 30, 2025.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter the “Board”) are vested with decision making powers on behalf of the County; and
WHEREAS, the Department of Human Services (hereafter “Department”) is an umbrella social service agency concerned with planning and funding services for disadvantaged and homeless citizens; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.1, authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized good and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) specifically authorizes the County to utilize competitive contracting to procure services related to the administration of social service programs, under which this program falls; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R2017-0370, dated May 9, 2017, authorizing the Department to initiate the RFP process in connection with the Adult Basic Education programs in Passaic County; and
WHEREAS, on August 23, 2023, the Purchasing Agent unsealed responses to Programs for WorkFirst New Jersey Temporary Assistance for Needy Families/General Assistance/Supplemental Nutrition Assistance Program (hereafter “TANF/GA/SNAP”) for the County Department of Human Services, Administered by The County Department of Human Services, RFP-23-025 (hereafter “RFP-23-025”); and
WHEREAS, in accordance with the law, a Review Committee was convened to review the responses to RFP-23-025, and in a memorandum dated September 5, 2023, recommended an award of service contract to Cultural Learning Center, Inc., 193 Haledon Avenue, Paterson, New Jersey 07522, in the amount of two hundred thousand ($200,000.00) dollars to provide WorkFirst New Jersey TANF/GA/SNAP participants with Adult Basic Education, with a contract term from September 1, 2023 through June 30, 2024, with three (3) one-year options to renew; and
WHEREAS, the original award was granted under Resolution R23-0883, dated September 26, 2023; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for proposals is a fair and open process, specifically, the request for proposals for the project under RFP-23-025 are publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, the Director of the Department is requesting that the first one-year option to renew be exercised for the term July 1, 2024 to June 30, 2025; and
WHEREAS, funds are available in any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the August 6, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) is authorizing the first one-year option to renew to Cultural Learning Center, Inc., 193 Haledon Avenue, Paterson, New Jersey 07522, in the amount of two hundred thousand and 00/100 ($200,000.00) dollars to provide WorkFirst New Jersey TANF/GA/SNAP participants with Adult Basic Education, with a contract term from July 1, 2024 through June 30, 2025; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of the Board, Director of Human Services, and Purchasing Agent are authorized to take any other steps necessary to carry out the purpose of this Resolution.
