RESOLUTION AUTHORIZING ACCEPTANCE, FINAL PAYMENT AND PROJECT CLOSE OUT TO M & M CONSTRUCTION COMPANY, INC., FOR THE LAMBERT CASTLE CARRIAGE HOUSE RESTORATION AND REHABILITATION PROJECT, PER BID C-22-023, PURSUANT TO N.J.S.A. 40A:11-16.3(b) ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-16.3(b), et seq. the Board can authorize release and final payment upon acceptance of the work performed pursuant to the contract provided that the contract has been completed; and
WHEREAS, on September 16, 2022, the Purchasing Agent issued C-22-023, Lambert Castle Carriage House Rehabilitation & Restoration (hereafter “C-22-023”), seeking sealed proposals from qualified bidders for the Lambert Castle Carriage House Rehabilitation & Restoration Project (hereafter “Project”); and
WHEREAS, on November 22, 2022, the Board approved Resolution No. R-22-1050, authorizing an award of contract to M & M Construction Company, Inc., under C-22-023, in the total amount of five million one hundred sixty thousand dollars ($5,160,000.00); and
WHEREAS, on May 9, 2023, the Board passed Resolution No. R-23-0462 authorizing Change Order No. 1 to M&M Construction Company, Inc., for the project in the increased amount of twenty-one thousand one hundred eight dollars and twenty-eight cents ($21,108.28), due to unforeseen masonry repairs and tree removal to provide access for masonry repairs needed to complete the Project, with a new total contract award, as a result of the increase, in the amount of five million one hundred eighty-one thousand one hundred one dollars and twenty-eight cents ($5,181,101.28)
WHEREAS, on September 26, 2023, the Board passed Resolution No. R-23-0897 authorizing Change Order No. 2 to M&M Construction Company, Inc., for the project in the increased amount of seven thousand eight hundred ninety-nine dollars and thirty-nine cents ($7,899.39), to install a concrete slab for a new door, now needed to complete the Project, with a new total contract award, as a result of the increase, in the amount of five million one hundred eighty-nine thousand and sixty-seven cents ($5,189,000.67); and
WHEREAS, on January 23, 2024, the Board passed Resolution No. R-24-0066 authorizing Change Order No. 3 to M&M Construction Company, Inc., in the amount of forty-five thousand three hundred eighty-two dollars and fifty cents ($45,382.50), as a result of the increase, in the amount of five million two hundred thirty-four thousand three hundred eighty-three dollars and seventeen cents ($5,234,383.17); and
WHEREAS, on February 13, 2024, the Board passed Resolution No. R-23-0137. authorizing Change Order No. 4 (incorrectly identified as Change Order No. 3) to M&M Construction Company, Inc., in the increased amount of fifty-five thousand four hundred seventeen dollars and sixty-six cents ($55,417.66), with a new total award amount, as a result of the increase, in the amount of five million two hundred eighty-nine thousand eight hundred dollars and eighty-three cents ($5,289,800.83); and
WHEREAS, on August 13, 2024, the Director of the Department of Cultural & Historic Affairs recommended Change Order No. 5 to M&M Construction Company, Inc., be authorized in the increased amount of twenty-seven thousand four hundred six dollars and twenty-three cents ($27,406.23) with a new total contract award, as a result of the increase, in the amount of five million three hundred seventeen thousand two hundred seven dollars and six cents ($5,317,207.06);
WHEREAS, the Director of the Department of Cultural & Historic Affairs is advising that the Project is complete and conforms to Passaic County construction plans, standard specifications, and other engineering standards, and is requesting that the Board approve project close out, final acceptance, release of retainage, and final payment to M&M Construction Company, Inc., in the amount of twenty-eight thousand dollars ($28,000.00); and
WHEREAS, this matter was discussed at the July 31, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-16.3(b) et seq., by the Passaic County Board of County Commissioners hereby authorizes and approves project close out, final acceptance, release of retainage, and final payment to M&M Construction Company, Inc., in the amount of twenty-eight thousand dollars ($28,000.00) for the Lambert Castle Carriage House Rehabilitation & Restoration, in the City of Paterson, and the Director of Finance is hereby authorized to make payment to said company on the next bill list.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of Board of County Commissioners are authorized to execute any documents and forms necessary, and take any other action necessary to carry out the purpose of this Resolution.
