RESOLUTION REJECTING ALL RESPONSES RECEIVED UNDER REQ-24-070, THE PASSAIC COUNTY COURT HOUSE EXTERIOR RESTORATION PROJECT, PURSUANT TO N.J.S.A. 40A: 11-13.2(d)

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(m) specifically authorizes the County to utilize competitive contracting to procure consulting services; and
WHEREAS, on June 26, 2024, the Purchasing Agent issued RFQ-24-070, Contractor Pre-Qualification for the Passaic County Court House Exterior Restoration in the County of Passaic (hereafter “RFQ-24-070”), seeking sealed proposals from qualified bidders for professional services for the Passaic County Court House Exterior Restoration Project for a contract period beginning on the award of contract for twelve consecutive months; and
WHEREAS, on July 10, 2024, the Purchasing Agent unsealed responses to the Passaic County Court House Exterior Restoration Project, RFQ-24-070 (hereafter “RFQ-24-070”); and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(a), the County is rejecting all bids received in response to RFQ-24-070 because the County wants to substantially revise the specifications for the goods and services sought therein; and
WHEREAS, this matter was discussed via email on August 9, 2024, and is being recommended to the Board for approval by the County’s Director of the Department of Cultural & Historic Affairs; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-13.2(d), the Passaic County Board of County Commissioners is rejecting all of the responses to RFQ-24-070, the Passaic County Court House Exterior Restoration in the County of Passaic Project because the County wants to substantially revise the specifications for the goods and services sought therein.
LET IT BE FURTHER RESOLVED, that the Purchasing Agent is authorized to take all necessary action to carry out the purpose of this resolution.
