RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO H&M ROHSLER NURSERY, INC., TO PROVIDE PLANTS, FLOWERS, AND GARDENING PRODUCTS FOR THE PASSAIC COUNTY PARK SYSTEM, PER SB-24-053, PURSUANT TO N.J.S.A 40A:11-4 ET SEQ.

WHEREAS, the County of Passaic (“County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on June 17, 2024, the Passaic County Purchasing Agent (“Purchasing Agent”) issued SB-24-050 seeking a Bid Plant Catalog Bid (“SB-24-050”), in compliance with N.J.S.A. 40A:11-4 et seq.; and
WHEREAS, no vendor responded to SB-24-050; and
WHEREAS, on July 3, 2024, the Purchasing Agent issued SB-24-053 seeking a Re-Bid Plant Catalog Bid at a discount price (“SB-24-053”), beginning on September 7, 2024, through September 6, 2026, in compliance with the following discount prices; and

3. 2024 Nursery Catalog: 30%
4. 2024 Annual Catalog: 25%
Delivery
1. 2024 Perennial Catalog 1 & 2 Gallon: 10%
2. 2024 Perennial Grasses: 10%
3. 2024 Nursery Catalog: 10%
4. 2024 Annual Catalog: 10%
Delivery time after receipt of the order is 10 days.
WHEREAS, one bid was received from the following vendor:
1. H&M Rohsler Nursery Inc.
WHEREAS, the Director of the Department of Parks & Recreation recommends an award of contract to H&M Rohsler Nursery Inc., to provide plants, flowers, and gardening products for the Passaic County Park System at the discount prices referenced herein this Resolution, in an amount not to exceed seventy thousand dollars ($70,000.00); and
WHEREAS, funds are available in Account No. 0-24-56-635-002-608, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed via email on August 28, 2024, by the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to H&M Rohsler Nursery Inc., to provide plants, flowers, and gardening products for the Passaic County Park System at discount prices referenced herein this Resolution, in an amount not to exceed seventy thousand dollars ($70,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, and Director of the Department of Parks & Recreation execute any documents required and take any other steps necessary to carry out the purpose of this resolution.
