RESOLUTION AUTHORIZING THE RETIREMENTS OF MOUNT DOC AND MOUNT DUKE (HORSES) FROM ACTIVE SERVICE WITH THE PASSAIC COUNTY SHERIFF’S OFFICE MOUNTED DIVISION AND THE TRANSFER OF OWNERSHIP TO ELITE EQUINE 3 LOCATED IN GARRET MOUNTAIN IN WOODLAND PARK, PURSUANT TO N.J.S.A. 40A:11-36(6)

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-36(6), if the estimated fair value of the property to be sold does not exceed the applicable bid threshold in any one sale or it is livestock or perishable goods, government property may be sold at a private sale without advertising for bids; and
WHEREAS, Mount Doc and Mount Duke (horses) have each come to the end of their useful service with the Passaic County Sheriff's Office (hereafter “PCSO”) Mounted Division; and
WHEREAS, Mount Doc and Mount Duke are deemed livestock and may be sold at a private sale without advertising for bids, pursuant to N.J.S.A. 40A:11-36(6); and
WHEREAS, the Passaic County Sheriff’s Office desires to retire Mount Doc and Mount Duke from active service with the Passaic County Sheriff’s Office Mounted Division due to their ages and transfer ownership to Elite Equine 3, located in Garret Mountain in Woodland Park, for the sale price of one dollar ($1.00); and
WHEREAS, Mount Doc and Mount Duke will live out the remainder of their lives at Elite Equine 3, without any liability or other expense to the County; and
WHEREAS, the PCSO now seeks approval of the Board to accomplish same; and
WHEREAS, this matter has been reviewed by the Law and Public Safety Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, that the Board of County Commissioners of the County of Passaic hereby authorizes the Passaic County Sheriff’s Office to retire Mount Doc and Mount Duke (horses) from active service with the Passaic County Sheriff's Office Mounted Division and transfer ownership to Elite Equine 3, located in Garret Mountain in Woodland Park, for the sale price of one dollar ($1.00).
LET IT BE FURTHER RESOLVED, that the Sheriff or his designee, Director of the Board of County Commissioners, County Administrator, County Counsel, Clerk of the Board, Chief Financial Officer, and any other employee for the County of Passaic may take any action necessary to effectuate the purpose of this Resolution.
