RESOLUTION AUTHORIZING THE PURCHASE OF SPECIAL EQUIPMENT AND THREE-YEAR WARRANTY FROM SUMURI, LLC, FOR THE USE OF CONFIDENTIAL AND UNDERCOVER INVESTIGATIONS FOR THE PASSAIC COUNTY SHERIFF’S OFFICE PURSUANT TO N.J.S.A. 40A:11-5(1)(g), ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(i) specifically authorizes the County to utilize competitive contracting to procure vendors for any good or service, except under N.J.S.A. 40A:11-5(1)(g), which includes the acquisition of special equipment for confidential investigations subject to prior approval of the Attorney General of the State of New Jersey; and
WHEREAS, the Attorney General of the State of New Jersey has approved said purchase in accordance with its approval letter dated July 29, 2024, which is incorporated by referenced and made a part of this Resolution; and
WHEREAS, the Passaic County Sheriff’s Office is recommending a contract to Sumuri, LLC, to purchase special equipment and a three-year warranty for the use of confidential and undercover investigations for the Department in the amount of in the amount of forty-nine thousand four hundred ninety-nine dollars ($49,499.00), pursuant to N.J.S.A. 40A:11-5(1)(g); and
WHEREAS, funds are available in Account No. T-22-56-850-012-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 or subsequent years’ County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed by the Law and Public Safety Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5(1)(g), the Board of County Commissioners of the County of Passaic authorizes an award of contract to Sumuri, LLC, for the purchase of confidential, undercover investigations and three-years warranty on the items for the Passaic County Sheriff’s Office in the amount of forty-nine thousand four hundred ninety-nine dollars ($49,499.00), in accordance with the Attorney General’s approval letter, dated July 29, 2024, which is incorporated by referenced and made a part of this Resolution.
LET IT BE FURTHER RESOLVED, that the Passaic County Purchasing Agent is authorized to take all necessary action to carry out the purpose of this Resolution and initiate the competitive contracting process in compliance with N.J.S.A. 40A:11-1, et seq.
LET IT BE FURTHER RESOLVED that the County Administrator, County Counsel, Sheriff, Clerk of the Board, and Chief Financial Officer are authorized to take all necessary action to carry out the purpose of this Resolution.
