RESOLUTION AUTHORIZING A NON-FAIR AND OPEN CONTRACT TO FBI LEEDA INC., FOR THE PURCHASE OF LAW ENFORCEMENT TRAINING FOR ALL SWORN-IN OFFICERS FOR THE PASSAIC COUNTY SHERIFF’S AND PROSECUTOR’S OFFICES, PURSUANT TO N.J.S.A. 40A:11-3.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, the Passaic County Sheriff’s and Prosecutor's Offices were unable to procure another vendor to provide a quote for the specific type of specialized training being sought under this resolution; and
WHEREAS, FBI Leeda, Inc., has executed and notarized the County’s Business Entity Disclosure Certification for non-fair and open contract required under N.J.S.A. 19:44A-20.8, stating that FBI Leeda, Inc., has not made and will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1, et seq. that would bar the award of this contract, which is attached hereto and made part of this resolution; and
WHEREAS, the Passaic County Sheriff’s and Prosecutor’s Offices are recommending the award of the non-fair and open contract to FBI Leeda, Inc., in an amount not to exceed ten thousand dollars ($10,000.00) to provide law enforcement training for all sworn-in officers; and
WHEREAS, funds are available in account numbers 4-01-20-109-001-213 ($5,000.00) and 4-01-22-130-002-217 ($5,000.00), or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed by the Law and Public Safety Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 19:44A-20.4, the Board of County Commissioners of the County of Passaic hereby authorizes the purchase of law enforcement training from FBI Leeda Inc., in an amount not to exceed ten thousand dollars ($10,000.00).
LET IT BE FURTHER RESOLVED, the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract with FBI Leeda Inc., for law enforcement training.
LET IT BE FURTHER RESOLVED, that the Purchasing Agent and all other necessary officers and employees are hereby authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this resolution, including but not limited to the issuance of the appropriate Purchase Orders.
