RESOLUTION REJECTING ALL RESPONSES RECEIVED UNDER RFP-24-023, CONSULTING SERVICES FOR PASSAIC COUNTY MARKETING AND ADVERTISING CAMPAIGNS, PURSUANT TO N.J.S.A. 40A: 11-13.2(a)

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(m) specifically authorizes the County to utilize competitive contracting to procure consulting services; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R20210310 dated March 23, 2021, authorizing the use of competitive contracting to provide marketing, advertising, and public relations consulting services to promote tourism within the County; and
WHEREAS, on August 23, 2024, the Purchasing Agent unsealed responses to Consulting Services for Passaic County Marketing and Advertising Campaigns, RFP-24-023 (hereafter “RFP-24-023”); and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(a), the County is rejecting all bids received in response to RFP-24-016, because the lowest bid substantially exceeds the cost estimates for the services sought therein; and
WHEREAS, this matter was discussed at the September 11, 2024 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-13.2(a), the Passaic County Board of County Commissioners is rejecting all of the responses to RFP-24-023, Consulting Services for Passaic County Marketing and Advertising Campaigns, because the lowest bid substantially exceeds the cost estimates for the services sought therein.
LET IT BE FURTHER RESOLVED, that the Purchasing Agent is authorized to take all necessary action to carry out the purpose of this resolution.
