RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO THE PASSAIC COUNTY WORKFORCE DEVELOPMENT CENTER FOR ONE STOP CAREER CENTER OPERATIONS MANAGEMENT SERVICES FOR THE PERIOD OF NOVEMBER 1, 2024, TO JUNE 30, 2025, PURSUANT TO N.J.S.A. 40A:11-4.1, ET.SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the Department of Human Services (hereafter “Department”) is an umbrella social service agency concerned with planning and funding services for disadvantaged and homeless citizens; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b) specifically authorizes the County to utilize competitive contracting to procure services related to the administration of social services programs, under which this program falls; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R20170370, dated May 9, 2017, authorizing the Department to initiate the RFP process to select a One Stop Operator for Passaic County; and
WHEREAS, on September 17, 2024, the Purchasing Agent unsealed responses to New Jersey One Stop Career Center Operations Management Services for the Passaic County Workforce Development Board RFP 24-031 (hereafter “RFP 24-031”); and
WHEREAS, in accordance with the law, a Review Committee convened to review the responses to RFP 24-031, and in a memorandum dated September 20, 2024, attached to and made part of this Resolution, recommended an award of contract to the Passaic County Workforce Development Center for One Stop Career Center Operations Management Services in the amount of eighty three thousand one hundred thirty five and 00/100 ($83,135.00) dollars, commencing on November 1, 2024 to June 30, 2025, with one (1) option year contingent on the availability of funds and performance; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for proposals is a fair and open process, specifically, the request for proposals for the projects under RFP-24-031 are publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, funds are available in Account Nos.G-01-41-726-24-PE1, G-01-041-725-24-PE1, G-01-041-721-24-PE1, G-01-41-729-24-PE1, G-01-041-723-24-PE1, G-01-041-722-24-PE1 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendor executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the October 1, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) is authorizing a contract award to the Passaic County Workforce Development Center for One Stop Career Center Operations Management Services, in the amount of eighty three thousand one hundred thirty five and 00/100 ($83,135.00) dollars, for a term commencing November 1, 2024 to June 30, 2025 with one (1) option year; and
LET IT BE FURTHER RESOLVED, the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contracts to the approved vendors as stated herein and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, and County Counsel are authorized to take any other steps necessary to carry out the purpose of this Resolution.
