RESOLUTION AUTHORIZING THE COUNTY TO GRANT A TEMPORARY EASEMENT TO NIKI- J&J HAWTHORNE PARTERS, LLC, ON A PORTION OF COUNTY RIGHT-OF-WAY NEAR 976 GOFFLE ROAD IN THE BOROUGH OF HAWTHORNE, PURSUANT TO N.J.S.A. 40:20-1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, Goffle Road in the Borough of Hawthorne is a County road, and the County is responsible for the maintenance of such right-of-way; and
WHEREAS, Niki J&J Hawthorne Partners, LLC, is the contract purchaser of certain real property located at 976 Goffle Road in the Borough of Hawthorne, and is in the process of conducting an environmental investigation; and
WHEREAS, as part of the environmental investigation Niki J&J Hawthorne Partners, LLC, desires to install two monitoring wells within the County right-of-way on Goffle Road adjacent to 976 Goffle Road for a maximum of three (3) years; and
WHEREAS, Niki J&J Hawthorne Partners, LLC, shall indemnify the County for any and all losses or claims associated with the installation and maintenance of said monitoring wells; and
WHEREAS, this matter was discussed at the October 9, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, that the Board of County Commissioners of the County of Passaic hereby grants a temporary easement to the Niki J&J Hawthorne Partners, LLC, to install two monitoring wells within the County right-of-way on Goffle Road adjacent to 976 Goffle Road for a maximum of three (3) years, as delineated in the Deed of Temporary Easement, attached hereto and made part hereof.
LET IT BE FURTHER RESOLVED, the Director of the Board of County Commissioners, Clerk of the Board and County Counsel are hereby authorized to execute a Deed of Temporary Easement on behalf of Passaic County.
