RESOLUTION AUTHORIZING THE SALE OF SURPLUS COUNTY PROPERTY ON GOVDEALS.COM IN ACCORDANCE WITH LOCAL FINANCE NOTICE (LFN) 2008-9; 2008-21R AND 2019-15, PER RFP-21-001, PURSUANT TO N.J.S.A. 40A:12-13(a) ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County of Passaic is the owner of certain surplus personal property which is no longer needed for public use; and
WHEREAS, pursuant to N.J.S.A. 40A:12-13(a), the County may sell personal property, not needed for public use, provided that such sale is authorized via resolution and done through open public sale at auction to the highest bidder after advertisement thereof; and
WHEREAS, the Board of County Commissioners are desirous of selling certain surplus property in an “as is” condition without express or implied warranties as detailed in Schedule A, attached hereto and made part hereof; and
WHEREAS, pursuant to N.J.S.A. 40A:12-13(a), the Purchasing Agent is seeking authorization to enter into an agreement with GovDeals to auction surplus vehicles and equipment through an on-line auction subject to the terms and conditions on GovDeals’s website and in the Clerk’s office, said vendor being approved by the Division of Local Government Services as noted in Local Finance Notice (LFN) 2008-9, (LFN) 2008-21R and (LFN) 2019-15.
WHEREAS, this matter was discussed at the October 9, 2024 Administration and Finance Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-13(a), the Board of County Commissioners of the County of Passaic authorizes the sale of surplus property, in the following manner:
(1) The sale of the surplus property shall be conducted through GovDeals subject to the terms and conditions of the agreement entered into with GovDeals, which are available online at www.GovDeals.com and are also available in the Office of the Passaic County Clerk of the Board.
(2) The sale will be conducted online and the address of the auction site is GovDeals.com
(3) The sale is being conducted pursuant to Local Finance Notice(s) 2008-9, 2008-21R and 2019-15.
(4) The surplus property consists of surplus Vehicles and Equipment located in various Passaic County locations. A formal list of property to be auctioned was provided by the Passaic County Purchasing Agent and is attached hereto as Schedule A;
(5) The surplus property as identified shall be sold in an “as-is” condition without express or implied warranties with the successful bidder required to execute a Hold Harmless and Indemnification Agreement concerning use of said surplus property.
(6) The County of Passaic reserves the right to accept or reject any bid submitted; and
LET IT BE FURTHER RESOLVED, that the Purchasing Agent, County Counsel, County Administrator, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
