RESOLUTION AMENDING RESOLUTION NO. 23-1173 AUTHORIZING UPDATE OF THE PARKS AND RECREATION PERMIT INFORMATION PACKET, PURSUANT TO N.J.S.A. 40:32-7.7, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:32-7.7 the Board operates and maintains over sixteen thousand (16,000) acres of preserved open space and recreational facilities as part of the Passaic County Park System, through the Department of Parks and Recreation (hereafter “Department”); and
WHEREAS, pursuant to N.J.S.A. 40:32-7.12, the Board may by resolution, make, alter, amend, and repeal rules and regulations for the supervision, regulation, and control of all activities carried on, conducted, sponsored, arranged, or provided for in connection with the Passaic County Park System, and may prescribe and enforce fines and penalties for the violation of any such rule or regulation; and
WHEREAS, on December 12, 2023, the County adopted Resolution No. R-23-1173, amending Resolution No. R-22-1144 dated December 13, 2022, itself an amendment of Resolution No. R20211170 authorizing updates to the Parks and Recreation information packet; and
WHEREAS, the Director of Parks and Recreation is recommending an amendment to Resolution No. R-23-1173 to include updates to the Park Permit Information Packet specifying the following changes: 1) addition of definitions for “organized athletic groups” and private coaching instruction, 2) updates to permit application dates for the new year, 3) updates to prohibited items; 4) updated language concerning moving/removing park benches, 5) addition of “emergency park closures” as a reason to grant refunds within two weeks from event; 6) update to Sheriff’s Department fees; 7) addition of language concerning security deposit policy; 8) addition of warming shelter parking lot to event parking fee locations; 9) inclusion of Great Meadow Picnic Pavillion to every cross-country meet at Garret Mountain Reservation; 10) Addition of parking rules for cross-country practices; 11) clarification that a food truck concession permit is required for each truck a concessionaire owns; 12) increase in permit fees; 13) removal of language for food truck permittees; 14) improvements and updates to language regarding park locations, and 15) inclusion of grill count for certain picnic pavilions; and
WHEREAS, this matter was discussed at the November 6, 2024, Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:32-7.7 et seq. that the Board of County Commissioners of the County of Passaic authorizes the amendment of Resolution No. R-23-1173 to include updates to the Park Permit Information Packet specifying the changes as listed above.
LET IT BE FURTHER RESOLVED, that all the other terms and conditions as set forth in Resolution No. R20211170 and Resolution No. R-22-1144 remain in full force and effect.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Board of County Commissioners, and Purchasing Agent are authorized to take any other action necessary to carry out the purpose of this Resolution.
