RESOLUTION AUTHORIZING PROJECT CLOSEOUT, FINAL ACCEPTANCE, AND FINAL PAYMENT TO NEW PRINCE CONCRETE CONSTRUCTION COMPANY FOR THE RECONSTRUCTION OF PATERSON HAMBURG TURNPIKE AND ALPS ROAD INTERSECTION IN THE TOWNSHIP OF WAYNE, PER BID C-21-019, PURSUANT TO N.J.S.A. 11-16.3(b)

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-16.3(b), et seq. the Board can authorize release and final payment upon acceptance of the work performed pursuant to the contract provided that the contract has been completed; and
WHEREAS, on February 8, 2022, the Board approved Resolution No. R-22-0093 awarding a contract to New Prince Concrete Construction for the Reconstruction of the Paterson Hamburg Turnpike and Alps Road Intersection, in the Township of Wayne (hereafter “Project”) with a contract award amount of five million four hundred forty thousand three hundred ninety-five dollars and eighty-four cents ($5,440,395.84); and
WHEREAS, in compliance with N.J.A.C. 5:30-11.3 et seq., the Board has approved the following change orders for the Project to date:

WHEREAS, the Passaic County Engineer has advised that the Project has been completed and conforms to the construction plans, standard specifications, and County Engineering Standards; and
WHEREAS, the Passaic County Engineer recommends that Project Closeout, Final Acceptance, Release of Retainage, and Final Payment, in the amount of two hundred ninety-six thousand six hundred sixty dollars and eleven cents ($296,660.11) should be issued to the Contractor New Prince Concrete Construction Company as the work on the Project has been completed; and
WHEREAS, the majority of the construction award is being funded by the New Jersey Department of Transportation County Aid 2019 and 2020 grants; and
WHEREAS, funds are available in Account No. G-01-45-700-021-911, G-01-45-700-020-911, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the November 6, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-16.3(b), the Board of County Commissioners of the County of Passaic hereby approves the final payment to New Prince Concrete Construction Company in the amount of two hundred ninety-six thousand six hundred sixty dollars and eleven cents ($296,660.11) for the Reconstruction of the Paterson Hamburg Turnpike and Alps Road Intersection, in the Township of Wayne, and the Director of Finance is hereby authorized to make payment to said company on the next bill list.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, County Finance Officer, and Director of Board of County Commissioners are authorized to take any other action necessary to carry out the purpose of this Resolution and to execute any documents required by the NJDOT for project grant reimbursement.
