RESOLUTION AUTHORIZING AWARD OF CONTRACT TO DELRIC CONSTRUCTION CO., INC., FOR RENOVATION OF THE PASSAIC COUNTY JOHNER BUILDING AT 11 EDGAR DRIVE IN THE TOWNSHIP OF WEST MILFORD, NEW JERSEY, PER BID C-24-024, PURSUANT TO N.J.S.A 40A: 11-4 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, the County desires to initiate a project for renovations of the Johner Building located at 11 Edgar Drive in West Milford, New Jersey (hereafter “Project”), which will include the installation of new finishes, new bathrooms, renovation of layout, mechanical systems, concrete stairs, ramps and new canopies over the ramp and stair; and
WHEREAS, on October 18, 2024, the Purchasing Agent issued Improvements For The: Passaic County Johner Building (hereafter “C-24-024”) seeking sealed proposals from qualified bidders for the Project; and
WHEREAS, on November 7, 2024, bids were unsealed for C-24-024 by the Purchasing Agent with Delric Construction Co., Inc., being the lowest responsible bidder; and
WHEREAS, the Passaic County Engineer is recommending an award of contract Delric Construction Co., Inc., for the Project in an amount not to exceed five million three hundred forty-two thousand dollars ($5,342,000.00), such figure including the alternate bid being accepted in the amount of two hundred thirty-nine thousand dollars ($239,000.00); and
WHEREAS, the County complied with the legal requirements as set forth under N.J.S.A. 40A:11-23 and the County is making the award of contract in accordance with the requirements under N.J.S.A. 40A:11-24(a); and
WHEREAS, sixty-two percent (62%) of this Project is being funded through the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (P.L. 116-123); the Coronavirus Aid, Relief, and Economic Security Act, 2020 (the “CARES Act”) (P.L. 116-136); the Paycheck Protection Program and Health Care Enhancement Act (P.L. 116-139); and/or H.R. 133 - Consolidated Appropriations Act, 2021, Division M - Coronavirus Response and Relief Supplemental Appropriations Act, 2021; American Rescue Plan Act of 2021, (P.L. 117-2); and
WHEREAS, funds are available in Account No. G-01-41-964-021-RLO, G-01-41-753-023-906, G-01-41-773-020-SUB, G-01-41-773-020-PE1, G-01-41-816-022-213, T-20-56-870-007-801, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed via email on November 12, 2024 with the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4 et seq., the Board of County Commissioners of the County of Passaic authorizes an award of contract to Delric Construction Co., Inc., for the renovations of the Johner Building located at 11 Edgar Drive in West Milford, New Jersey, C-24-024 in an amount not to exceed five million three hundred forty-two thousand dollars ($5,342,000.00) such figure including the alternate bid being accepted in the amount of two hundred thirty-nine thousand dollars ($239,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Finance Officer, County Engineer, and the Director of the Board of County Commissioners are authorized to execute an agreement with Delric Construction Co., Inc., and take any other steps necessary to carry out the purpose of this Resolution and for any documents required for reimbursements.
