RESOLUTION ACCEPTING UNIT BID PRICES FROM VENDORS FOR ON-CALL CONSTRUCTION & GEOTECHNICAL TESTING SERVICES FOR VARIOUS LOCATIONS THROUGHOUT PASSAIC COUNTY ON AN AS-NEEDED BASIS FOR THE TWO-YEAR PERIOD OF JANUARY 1, 2025 THROUGH DECEMBER 31, 2026 AS PER BID SB-25-005 PURSUANT TO N.J.S.A 40A: 11-1, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on October 3, 2024, the Purchasing Agent issued SB-25-005 On-Call Construction & Geotechnical Testing (hereafter “SB-25-005”) seeking sealed proposals from qualified bidders for On-Call Construction and Geotechnical Testing Services on an as-needed basis beginning on January 1, 2025 and expiring on December 31, 2026; and
WHEREAS, on October 22, 2024, bids were unsealed for SB-25-005 by the Purchasing Agent and a total of two (2) qualified bids were received:
1. French and Parrello Associates, PA;
2. Colliers Engineering & Design, Inc.
WHEREAS, the purpose of SB-25-005 was to establish a pool of qualified testing companies with established unit prices for a two-year period. These services include concrete testing, asphalt testing, geotechnical borings and the various laboratory testing, analysis and reporting, for a time period between January 1, 2025 and December 31, 2026 and the County may enter into project-specific agreements with any of the bidders based on submitted unit bid prices; and
WHEREAS, County Engineer has recommended the acceptance of the unit bid prices from the two (2) qualified bidders under SB-25-005 on an as-needed basis for the period January 1, 2025 and December 31, 2026; and
WHEREAS, this matter was discussed on November 6, 2024 by the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-1 et seq. the Passaic County Board of County Commissioners hereby accepts the unit pricing schedule contained in the bid submitted by French & Parrello Associates, PA and Colliers Engineering and Design, Inc., the On-Call Construction & Geotechnical Testing Services under SB-25-005 for a two-year period beginning on January 1, 2025 and expiring on December 31, 2026 as recommended by the County Engineer.
LET IT BE FURTHER RESOLVED, that specific contracts shall be awarded on an “as needed” basis by subsequent resolution and purchase order, subject to certification of available funds.
LET IT BE FURTHER RESOLVED, that said contracts shall be awarded to the bidder with the lowest aggregate pricing as determined by the established fee schedules.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Passaic County Board of County Commissioners are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
