RESOLUTION AUTHORIZING THE PURCHASE OF AN ACTIVE SHOOTER TRAINING CLASS BY THE OFFICE OF EMERGENCY MANAGEMENT FOR PASSAIC COUNTY LAW ENFORCEMENT OFFICERS, PURSUANT TO N.J.S.A. 52:34-10.6 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Office of Emergency Management (“OEM”) has requested to purchase the Patrol Officer Tactical Response to an Active Shooter training class from Tomahawk Strategic Solutions for the training of Passaic County law enforcement officers in an amount not to exceed twenty-five thousand dollars ($25,000.00); and
WHEREAS, N.J.S.A. 52-34-10.6(a) states in pertinent part that notwithstanding the provisions of any law to the contrary any purchase by the State, State agency, or local government unit of equipment, goods, or services related to homeland security and domestic preparedness that is paid for or reimbursed by federal funds awarded by the U.S. Department of Homeland Security or other federal agency may be made as an alternative to public bidding and subject to the provisions of this section, through direct purchase without advertising for bids or rejecting bids already received but not awarded; and
WHEREAS, said goods are being procured under GSA Schedule 84, contract # 47QSWA20D002T, as permitted by N.J.S.A. 52-34-10.6 et seq. and as specified below; and
WHEREAS, the purchase of said goods is funded by the FY-22 USASI Homeland Security Grant; and
WHEREAS, this matter was discussed by the Law and Public Safety Committee, on November 12, 2024, and is being recommended to the Board for approval; and
WHEREAS, the Board is desirous of approving said purchases in accordance with the terms of the applicable contracts and authorizing the Purchasing Agent to issue the appropriate Purchase Orders; and
WHEREAS, funds are available in account G-01-41-846-022-223 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2024, or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 52-34-10.6 et seq., the Board of County Commissioners of the County of Passaic hereby authorize the purchase of the following goods or services in accordance with the terms of the applicable contract:
