RESOLUTION AUTHORIZIING AN AWARD OF CONTRACT TO TURN OUT UNIFORMS INC., TO PROVIDE BADGES FOR THE PASSAIC COUNTY SHERIFF’S DEPARTMENT, AS PER BID # SB-25-007, PURSUANT TO N.J.S.A 40A: 11-4

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff’s Office (“PCSO”) has requested the purchase of badges for the Passaic County Sheriff’s Department; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on October 8, 2024, the Passaic County Purchasing Agent issued SB-25-007 Badges for the Passaic County Sheriff’s Department (“SB-25-007”), in compliance with N.J.S.A. 40A:11-4, et seq.; and
WHEREAS, on October 24, 2024, bids were unsealed for SB-25-007 by the Purchasing Agent with one (1) response from Turn Out Uniform, Inc.: and
WHEREAS, PCSO is recommending an award of contract to Turn Out Uniforms Inc., to provide badges for the Passaic County Sheriff’s Department in an amount not to exceed twenty thousand dollars ($20,000.00), ten thousand per year ($10,000.00), contingent on both 2025 and 2026 budgets; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed they are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No.: 5-01-22-130-002-247, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was reviewed by the Law and Public Safety Committee on November 12, 2024, and is being recommended to the full Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED pursuant to N.J.S.A. 40A:11-4, et seq., the Board of County Commissioners of the County of Passaic is authorizing a contract award to Turn Out Uniforms Inc., to provide badges for the Passaic County Sheriff’s Department in an amount not to exceed twenty thousand dollars ($20,000.00) for the length of the contract term at $10,000.00 per year contingent on both 2025 and 2026 budgets.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
