RESOLUTION AUTHORIZING THE PURCHASE OF INTERNET SERVICES FOR THE COUNTY’S DATA CENTERS FROM VERIZON BUSINESS NETWORK SERVICES LLC AND CROWN CASTLE FIBER LLC, PURSUANT TO N.J.S.A. 40A:11-12, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-12, et seq, the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract(s) for such goods and services entered into on behalf of the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, Crown Castle Fiber LLC has been awarded State Contract No. 22-TELE-80909 for T1776 Data Communications Network Services, including internet services, by the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, the County’s Purchasing Agent is recommending that the Board authorize an award of contract to Crown Castle Fiber LLC to provide 10 Gbps internet service for the County’s data center at 495 River Street in Paterson, for a period from November 1, 2024 to July 31, 2029, in an amount not to exceed one hundred sixty-five thousand six hundred dollars ($165,600.00), in accordance with State Contract No. 22-TELE-80909; and
WHEREAS, Verizon Business Network Services LLC has been awarded State Contract No. 22-TELE-80910 for T1776 Data Communications Network Services, including internet services by the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, the County’s Purchasing Agent is recommending that the Board authorize an award of contract to Verizon Business Network Services LLC to provide 10 Gbps internet service for the County’s data center at 401 Grand Street in Paterson, for a period from November 1, 2024 to July 31, 2029, in an amount not to exceed one hundred seventy-seven thousand sixty dollars ($177,060.00), in accordance with State Contract No. 22-TELE-80910; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., Verizon Business Network Services LLC and Crown Castle Fiber LLC executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that they are not involved in prohibited activities in Russia and Belarus, and the County confirmed that neither Verizon Business Network Services LLC nor Crown Castle Fiber LLC are identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. 4-01-31-221-001-U02, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the October 9, 2024 Administration and Finance Committee meeting, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12, et seq., the Board of County Commissioners of the County of Passaic authorizes the award of the following contracts for internet service, in a total amount not to exceed three hundred forty-two thousand six hundred sixty dollars ($342,660.00):
1. Crown Castle Fiber LLC for the provisions of 10 Gbps internet service to the County’s data center at 495 River Street in Paterson, for a period from November 1, 2024 to July 31, 2029, in an amount not to exceed one hundred sixty-five thousand six hundred dollars ($165,600.00), in accordance with State Contract No. 22-TELE-80909; and
2. Verizon Business Network Services LLC to provide 10 Gbps internet service for the County’s data center at 401 Grand Street in Paterson, for a period from November 1, 2024 to July 31, 2029, in an amount not to exceed one hundred seventy-seven thousand sixty dollars ($177,060.00), in accordance with State Contract No. 22-TELE-80910
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, Director of MIS, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
