RESOLUTION AWARDING A CONTRACT TO MARQUIS SOFTWARE DEVELOPMENT FOR THE eOMIS SOFTWARE SYSTEMS THAT TRACKS INCARCERATED INDIVIDUALS' MEDICAL HISTORY AND BOOKING TRIAGE FOR THE PASSAIC COUNTY SHERIFF’S OFFICE, PURSUANT TO N.J.S.A. 40A:11-5-(1)(dd).

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(dd), any contract the amount of which exceeds the bid threshold, may be negotiated and awarded by the governing body without public advertising for bids and bidding therefor and shall be awarded by resolution of the governing body if it is for the provision or performance of goods or services for the support or maintenance of proprietary computer hardware and software, except that this provision shall not be utilized to acquire or upgrade non-proprietary hardware or to acquire or update non-proprietary software; and
WHEREAS, on July 18, 2023, the Board adopted R-23-0699 authorizing an award of contract to Marquis Software Development, as the sole proprietor of the software, pursuant to N.J.S.A. 40A:11-3 in an amount not to exceed seven thousand dollars ($7,000); and
WHEREAS, on August 8, 2023, the Board adopted R-23-0776 to increase the award to Marquis Software Development to add an additional twelve thousand dollars ($12,000) for required interfacing, which was not part of the original quote for a total award of nineteen thousand dollars ($19,000) for the period from June 1, 2023, through December 31, 2023, pursuant to N.J.S.A. 40:11-5(1)(dd),; and
WHEREAS, on December 28, 2023, the Board adopted R-23-1281 authorizing a six-month contract extension to Marquis Software Development and appropriate funds of up to six thousand dollars ($6,000) to Marquis Software Development pursuant to N.J.S.A. 40:11-5(1)(dd), for a contract period from December 31, 2023 to June 30, 2024; and
WHEREAS, the Passaic County Prosecutor’s Office is recommending a contract to Marquis Software Development to provide eOmis Software that tracks the incarcerated individuals’ medical history and booking triage for an amount not to exceed fifteen thousand dollars ($15,000) for a contract period beginning October 1, 2024, and expiring on December 31, 2025; and
WHEREAS, Marquis Software Development executed and notarized the County’s Business Entity Disclosure Certification for non-fair and open contracts required pursuant to N.J.S.A. 19:44A-20.8, which is attached to and made part of this Resolution; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed they are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No.: 4-01-25-157-005-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed by the Law and Public Safety Committee, on November 12, 2024, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5(1)(dd) that the Board of County Commissioners of the County of Passaic authorizes a contract to Marquis Software Development to provide eOmis Software that tracks the incarcerated individuals’ medical history and booking triage for an amount not to exceed fifteen thousand dollars ($15,000); and
LET IT BE FURTHER RESOLVED, the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to Computer Square Inc., and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
