RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO ROAD SAFETY SYSTEMS, LLC, TO REPLACE AND REPAIR GUIDE RAILS ON PASSAIC COUNTY ROADS, RIGHT-A-WAYS, AND BRIDGES FOR 2024, PURSUANT TO N.J.S.A. 40A:11-10.

WHEREAS, the County of Passaic (“County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, in compliance with the law, Morris County Cooperative Pricing Council (“MCCPC”) issued and awarded a contract to Road Safety Systems, LLC, Beam Guide Rail & Safety Ends Contract-MCCPC #26 (“MCCPC #26 ”); and
WHEREAS, the Supervisor of Roads is recommending an award of contract to Road Safety Systems LLC, to replace and repair guide rails on Passaic County roads, rights-of-way, and bridges for 2024 under the guide rail removal and replacement program pursuant to N.J.S.A. 40A;11-10 in the amount of seventy-five thousand dollars ($75,000.00); and
WHEREAS, funds are available in Account Nos. C-04-55-176-002-906 ($46,924.66), C-04-55-182-002-905 ($28,075.34), or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2024 or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the November 6, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-10, that the Board of County Commissioners of the County of Passaic authorizes an award of contract to Road Safety Systems LLC, to replace and repair guide rails on Passaic County roads, rights-of-way, and bridges for 2024 under the guide rail removal and replacement program pursuant to N.J.S.A. 40A;11-10 in the amount of seventy-five thousand dollars ($75,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Purchasing Agent, Supervisor of Roads, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
