RESOLUTION AUTHORIZING AWARD OF CONTRACT TO MILLENNIUM COMMUNICATIONS GROUP, INC. FOR FIBER RIDEOUT MAINTENANCE AND REPAIRS, PURSUANT TO N.J.S.A. 40A:11-12, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-12, et seq, the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract(s) for such goods and services entered into on behalf of the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, Millenium Communications Group, Inc. has been awarded State Contract No. 22-TELE-45463 for T2989 - Communications Wiring Services, by the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and
WHEREAS, on November 22, 2024, the Department of Management and Information Systems received a quote from Millennium Communications Group, Inc., attached hereto and made part of this Resolution, to provide fiber rideout maintenance and repairs, in an amount not to exceed forty thousand four hundred sixty-three dollars and eighty-eight cents ($40,463.88), in accordance with State Contract No. 22-TELE-45463, which is being recommended to the Board for approval; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., Millenium Communications Group, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that Millenium Communications Group, Inc. is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account Nos. 4-01-20-111-003-220 ($40,388.21) and 4-01-20-111-003-219 ($75.67), or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the November 26, 2024 Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-12, et seq., the Board of County Commissioners of the County of Passaic authorizes the award of a contract to Millenium Communications Group, Inc. to provide fiber rideout maintenance and repairs, in an amount not to exceed forty thousand four hundred sixty-three dollars and eighty-eight cents ($40,463.88), in accordance with State Contract No. 22-TELE-45463
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of Management and Information Systems, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
