RESOLUTION AUTHORIZING A DIRECT CONTRACT AWARD TO WAYNE HOTEL LLC TO PROVIDE EMERGENCY NON-CONGREGATE HOMELESS SHELTER SERVICES TO COUNTY OF PASSAIC RESIDENTS IN CALENDAR YEAR 2025, AS APPROVED BY THE PASSAIC COUNTY DEPARTMENT OF HUMAN SERVICES, PURSUANT TO N.J.S.A. 40A:11-5(3), ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Department of Human Services (“Department”) is an umbrella social service agency concerned with planning and funding services for disadvantaged and homeless citizens; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on October 3, 2024, the Passaic County Purchasing Agent issued SB-25-006, Hotel Placement for Department of Human Services (“SB-25-006”), seeking sealed proposals from qualified bidders to provide emergency non-congregate shelter services to the County; and
WHEREAS, having received no bids in response to SB-25-006, on October 24, 2024, the Purchasing Agent issued SB-25-010, Re-Bid Hotel Placement for Department of Huaman Services (“SB-25-010”), seeking qualified bidders to provide emergency hotel placement to County residents, and no bids were received in response to SB-25-010; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(3), when bids have been advertised pursuant to N.J.S.A. 40A:11-4 on two occasions, having received no bids on either occasion in response to the advertisements, the County may negotiate a contract that may be awarded upon two-thirds affirmative vote of the Board; and
WHEREAS, the Purchasing Agent made reasonable efforts to confirm the services sought under SB-25-006 and SB-25-010 are not available to procure under any State contracts or cooperative agreements to which the County is a member of; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(3), the Executive Director of Human Services is recommending to make a direct contract award to Wayne Hotel LLC to provide emergency non-congregate shelter services to County residents in calendar year 2025, as approved by the Department of Human Services, in an amount not to exceed sixteen thousand two hundred and twenty-seven dollars ($16,227.00); and
WHEREAS, funds are available in Account No. G-01-41-818-024-213, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent County budget(s), which is attached hereto and made part of this Resolution; and
WHEREAS, this matter was discussed at the December 3, 2024, Health and Human Services Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5(3), the Board of County Commissioners of the County of Passaic authorizes a direct contract award to Wayne Hotel LLC to provide emergency non-congregate shelter services to County of Passaic residents in calendar year 2025, as approved by the Passaic County Department of Human Services, in an amount not to exceed sixteen thousand two hundred and twenty-seven dollars ($16,227.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service and amount of the contract to Wayne Hotel LLC, and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURHER RESOLVED, that the Clerk to the Board, County Counsel, Purchasing Agent, Executive Director of Human Services, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
