RESOLUTION AUTHORIZING CHANGE ORDER NO. 1 TO NICKERSON NY, LLC, FOR NEW LOCKERS AND BENCHES IN THE LOCKER ROOMS AT THE PASSAIC COUNTY POLICE ACADEMY IN THE TOWNSHIP OF WAYNE, PURSUANT TO N.J.A.C. 5:30-11.3

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Educational Service Commission of New Jersey Cooperative Contract Purchasing System, #65MCESCCPS, a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, which awarded a contract to Nickerson NY, LLC, under Lockers - Purchase, Installation & Repair, ESCNJ 22/23-43; and
WHEREAS, on August 13, 2024, the Board passed Resolution No. R-240-711, authorizing an award of contract to Nickerson NY, LLC, to install new lockers and benches in the locker rooms at the Passaic County Police Academy in the Township of Wayne (hereafter “Project”), in an amount not to exceed one hundred one thousand four hundred ninety-four dollars and twenty-five cents ($101,494.25); and
WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and
WHEREAS, the Passaic County Engineer is recommending that Change Order No. 1 be authorized for a net deduction to the contract for the Project in the amount of eight thousand dollars ($8,000.00) due to the change in locker door colors, with a new total contract amount, as a result of the decrease, in the amount of ninety-three thousand four hundred ninety-four dollars and twenty-five cents ($93,494.25); and
WHEREAS, this matter was discussed at the November 26, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board of County Commissioners of the County of Passaic approves Change Order No. 1 for the contract with Nickerson NY, LLC, for a net deduction to the contract for the Project in the amount of eight thousand dollars ($8,000.00), with a new total contract amount, as a result of the decrease, in the amount of ninety-three thousand four hundred ninety-four dollars and twenty-five cents ($93,494.25).
LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with all of the general requirements for change orders as set forth in N.J.A.C. 5:30-11.10, et seq.
