RESOLUTION AUTHORIZING ACCEPTANCE, FINAL PAYMENT AND PROJECT CLOSE OUT TO AB CONTRACTING, LLC, FOR PREAKNESS VALLEY GOLF COURSE CLUBHOUSE BATHROOM RENOVATIONS IN THE TOWNSHIP OF WAYNE, PER BID C-23-018, PURSUANT TO N.J.S.A. 40A:11-16.3(b) ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-16.3(b), et seq. the Board can authorize release and final payment upon acceptance of the work performed pursuant to the contract provided that the contract has been completed; and
WHEREAS, on October 30, 2023, the Purchasing Agent issued the Preakness Valley Golf Course Clubhouse Renovations, Bid No. C-23-018 (hereafter “C-23-021”) seeking proposals from qualified bidders to renovate the clubhouse bathrooms at Preakness Valley Golf Course in the Township of Wayne (hereafter “Project”); and
WHEREAS, on September 26, 2023, the Board passed Resolution No. R-23-0912, authorizing an award of contract to AB Contracting, LLC, in an amount not to exceed two hundred forty-four thousand dollars ($244,000.00); and
WHEREAS, on December 28, 2023, the Board passed Resolution No. R-23-1243 authorizing Change Order No. 1 to AB Contracting, LLC, for a net increase to the contract of the Project in the amount of thirty-five thousand three hundred eighty-one dollars and thirty-five cents ($35,381.35), with a new contract award, as a result of the increase of two hundred thirteen thousand dollars ($279,381.35); and
WHEREAS, on February 13, 2024, the Board passed Resolution No. R-24-0127 authorizing Change Order No. 2 to AB Contracting, LLC, for a net increase to the contract of the Project in the amount of thirty-seven thousand seventy-one dollars and two cents ($37,071.02), with a new contract award, as a result of the increase of three hundred sixteen thousand four hundred fifty-two dollars and thirty-seven cents ($316,452.37); and
WHEREAS, on April 9, 2024, the Board passed Resolution No. R-24-0320 authorizing Change Order No. 3 to AB Contracting, LLC, for a net increase to the contract of the Project in the amount of seven thousand five hundred dollars ($7,500.00), with a new contract award, as a result of the increase of three hundred twenty-three thousand nine hundred fifty-two dollars and thirty-six cents ($323,952.36); and
WHEREAS, the Passaic County Engineer is advising that the Project is complete and conforms to Passaic County’s construction plans, standard specifications, and other engineering standards, and is also requesting that the Board approve the Project’s close out, final acceptance, release of retainage, and final payment to AB Contracting, LLC, in the amount of twenty-two thousand two hundred sixty-four dollars and sixty-three cents ($22,264.63); and
WHEREAS, this matter was discussed at the November 26, 2024 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-16.3(b) et seq., by the Passaic County Board of County Commissioners hereby authorizes and approves project close out, final acceptance, release of retainage, and final payment to AB Contracting, LLC, in the amount of twenty-two thousand two hundred sixty-four dollars and sixty-three cents ($22,264.63) for renovations to the clubhouse bathrooms at Preakness Valley Golf Course in the Township of Wayne, and the Director of Finance is hereby authorized to make payment to said company on the next bill list.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of the Board of County Commissioners are authorized to execute any documents and forms necessary, and take any other action necessary to carry out the purpose of this Resolution.
