RESOLUTION AUTHORIZING AWARD OF CONTRACT TO COLONNELLI BROTHERS, INC. FOR ON-CALL CULVERT REPAIRS TO THE UNION STREET CULVERT #1600-436 IN THE BOROUGH OF HAWTHORNE PER BID C-24-002, PURSUANT TO N.J.S.A 40A: 11-4 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, the County desires to initiate on-call repairs at the Union Street Culvert No. 1600-436 in the Borough of Hawthorne due to damages caused by Hurricane Ida (hereafter “Project”), which will include repairs, debris removal, topsoiling, and all other items presented in the Plans and Specifications; and
WHEREAS, on December 13, 2023, the Purchasing Agent issued C-24-002, On Call Drainage Projects, (hereafter “C-24-002”) seeking sealed proposals from qualified bidders for On Call Drainage Projects, to be used on an as-needed basis; and
WHEREAS, on February 2, 2024, the Board passed Resolution R-24-57 qualifying a list of five (5) contractors and unit prices to perform on-call bridge and culvert repair drainage projects with established unit prices for a two-year period beginning on January 1, 2024, and expiring on December 31, 2025 to be hired on an as-needed basis, which included Colonnelli Brothers, Inc.; and
WHEREAS, the Passaic County Engineer is recommending an award of contract to Colonnelli Brothers, Inc. for the Project in an amount not to exceed thirty-nine thousand six hundred twenty-five dollars ($39,625.00); and
WHEREAS, the costs of these repairs will be reimbursed by the Federal Emergency Management Agency (“FEMA”); and
WHEREAS, funds are available in Account No. T-20-56-880-022-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the November 26, 2024 meeting of the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4 et seq., the Board of County Commissioners of the County of Passaic authorizes an award of contract to Colonnelli Brothers, Inc., for On-Call Culvert Repairs to the Union Street Culvert #1600-436, C-24-002 in an amount not to exceed thirty-nine thousand six hundred twenty-five dollars ($39,625.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Finance Officer, County Engineer and the Director of the Board of County Commissioners are authorized to execute an agreement with Colonnelli Brothers, Inc., and take any other steps necessary to carry out the purpose of this Resolution and any supporting documents required by FEMA for reimbursement.
