RESOLUTION EXERCISING THE SECOND ONE-YEAR OPTION TO RENEW THE CONTRACT WITH NEWARK YMCA UNDER RFP-23-005 FOR THE PROVISION OF YOUTH SHELTER BEDS FOR PASSAIC COUNTY AT-RISK INDIVIDUALS FOR CALENDAR YEAR 2025, PURSUANT TO N.J.S.A. 40A:11-4.1, ET.SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, the Department of Human Services (hereafter “Department”) is an umbrella social service agency concerned with planning and funding services for the County’s disadvantaged and homeless citizens; and
WHEREAS, the Division of Juvenile Administration administers programs under the State Juvenile Justice Commission, Passaic County Family Court, Juvenile Detention and
Alternate Programs, and the Youth Services Commission; and
WHEREAS, N.J.S.A. 40A:11-41 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b) specifically authorizes the County to utilize competitive contracting to procure services related to the administration of social services programs, under which this program falls; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R20100615, authorizing the use of competitive contracting for youth shelter beds for at-risk juveniles in Passaic County, and;
WHEREAS, on November 4, 2022, the County Purchasing Agent issued RFP-23-005 Youth Shelter Beds for Passaic County At-Risk Youth Grant Administered by the County Department of Human Services (“RFP-23-005”), responses to which were received on November 29, 2022; and
WHEREAS, in accordance with the law, a review committee was convened to review the response to RFP-23-005, and recommended an award of contract to Young Men's Christian Association of Newark & Vicinity Inc. (“Newark YMCA”) to provide youth shelter beds for at-risk Passaic County juveniles, which was approved by the Board in Resolution No. R-23-0042 for the 2023 calendar year, with three (3) one-year options to renew; and
WHEREAS, the Board exercised the first option to renew for calendar year 2024 under Resolution No. R-23-1227, dated December 28, 2023; and
WHEREAS, the Director of the Department is requesting that the second one-year option to renew the above-described contract with Newark YMCA be exercised for calendar year 2025, from January 1, 2025 to December 31, 2025, for a total amount of two hundred sixty-five thousand dollars ($265,000.00); and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., Newark YMCA executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that they are not involved in prohibited activities in Russia and Belarus, and the County confirmed that said vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. 5-01-27-170-002-205 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2025 and/or subsequent years’ County budge(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the December 17, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1 et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby exercises the second one-year option to renew its contract with Young Men's Christian Association of Newark & Vicinity Inc. under RFP-23-005 Youth Shelter Beds for Passaic County At-Risk Youth Grant Administered by the County Department of Human Services, for calendar year 2025, from January 1, 2025 to December 31, 2025, in the amount of two hundred sixty-five thousand dollars ($265,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, County Counsel, and Director of the Department of Human Services are authorized to take any other steps necessary to carry out the purpose of this Resolution.
