RESOLUTION APPOINTING KENNETH D. SUMTER TO THE PASSAIC COUNTY COMMUNITY COLLEGE BOARD OF TRUSTEES FOR A FOUR (4) YEAR TERM, RETROACTIVE TO NOVEMBER 1, 2023 AND EXPIRING OCTOBER 31, 2027, PURSUANT TO N.J.S.A. 18A:64A-8

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 18A:64A-1, et seq., the Board established the Passaic County Community College (“PCCC”); and
WHEREAS, pursuant to N.J.S.A. 18A:64A-8, for each county college in New Jersey there shall be a board of trustees, consisting of the county superintendent of schools and ten (10) persons, eight (8) of whom shall be appointed by the Board, in compliance with the conditions set forth therein; and
WHEREAS, pursuant to N.J.S.A. 18A:64A-9, appointed members of the Board of Trustees shall have been residents of the County for a period of four (4) years prior to their appointment, and no elected public official or employee of the County college shall serve as a voting member of the board of trustees; and
WHEREAS, on October 8, 2019, the Board passed Resolution No. R20190863, reappointing Harvey J. Nutter to the PCCC Board of Trustees for a new term, effective November 1, 2019 and expiring October 31, 2023; and
WHEREAS, Kenneth D. Sumter meets the requirements set forth in N.J.S.A. 18A:64A-9, and pursuant to N.J.S.A. 18A:64A-8, the PCCC Trustee Search Committee nominated Mr. Sumter for consideration by the Board for appointment to the PCCC Board of Trustees; and
WHEREAS, the County Administrator is recommending that Kenneth D. Sumter be appointed to the PCCC Board of Trustees for the unexpired term of Harvey J. Nutter, retroactive to November 1, 2023 and expiring on October 31, 2027; and
WHEREAS, this matter was discussed at the December 18, 2024 Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 18A:64A-8, the Board of County Commissioners of the County of Passaic appoints Kenneth D. Sumter to the Passaic County Community College Board of Trustees for the unexpired term of Harvey J. Nutter, retroactive to November 1, 2023 and expiring on October 31, 2027.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board shall send a certified copy of this Resolution to the President and General Counsel of the Passaic County Community College and shall keep a copy of same on file for public inspection.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
